technologies and new aircraft in today’s market are influencing the way manufacturers and regulatory agencies adapt when certifying and approving the installations of these new systems and airframes. Recognizing the need to adapt, the Federal Aviation Administration’s Part 23 Reorganization Aviation Rulemaking Committee has been created. The AEA is fully engaged in these meetings, with myself serving on the steering committee, and Ric Peri participating on the working committee. We’ve also hosted and will continue to host the committee meetings at our headquarters offices. Charged with creating a progressive, tiered certification system – from low-complexity, low-performance airplanes all the way to high-complexity, high-performance airplanes – so small recreational airplanes won’t have to be designed and certificated under the same regulatory requirements as heavier, more complex and higher-performance aircraft, the ARC includes representatives from the FAA’s Small Airplane Directorate, Aircraft Certification and Flight Standards Service, as well as aviation industry and community members. Besides the obvious, what’s most innovative about this particular ARC? It has to be the comradery of both industry and the regulatory bodies involved in composing this rewrite. In late July, during the Experimental Aircraft Association’s annual AirVenture in Oshkosh, Wis., the Part 23 steering committee convened to hear status updates on the ARC’s progress. (Keep in mind, this particular ARC is on a fast-track schedule. A final report is scheduled to be delivered to the FAA by spring 2013.) It was certainly refreshing to witness the enthusiasm and shared goals by both industry participants and FAA executives who were in the room. Many times, we view the relationship between industry and the regulators as a “we vs. them” affiliation. Not so in this case. And, I think much of this positive atmosphere is a credit to Earl Lawrence, manager of the FAA’s Small Airplane Directorate. As the main liaison between Part 23 industry committee members and the FAA, Lawrence is willing

to truly listen and reflect on industry’s opinions and suggestions. Of course, without painting too rosy of a picture, naturally there has been a fair share of debate and disagreement on the direction of the ARC amongst its members. But, what is most remarkable is that, to date, consensus is reached through open communications and a willingness from both sides to respect each other’s opinions. Amazing, considering this working group of industry leaders is modernizing Part 23 and simplifying certification requirements that have not been updated in more than 20 years. Perhaps the eagerness to work together and produce a wellthought-out rewrite is because the end result will be based on improved safety, reduced costs in both certification and price tag to the customer, and the promotion of innovation in our industry. So far, one important outcome from the committee’s work is the creation of an AOA “consensus” standard. Its benefits are two-fold: 1. It creates a standard for instruments used in light sport aircraft for parts that currently don’t have approved pedigree (TSO, PMA, etc.). 2. It creates the potential for additional product lines for light aircraft. The Industrial Revolution marked a major turning point in history, beginning in England and quickly spreading throughout the rest of the world. The introduction of new machinery meant new jobs, new products and the emergence of entrepreneurs designing goods and services that led to a brand new business culture. In some ways, the rewrite of Part 23 rules will be our own turning point in the history of the general aviation industry, and hopefully along the way, will mean even more new products, new efficiencies, enhanced safety and a return to a thriving, robust industry. q
