TSA's security-related statutory and
regulatory responsibilities.
For repair stations not required to
carry out security measures on a regular basis (i.e., those repair stations not
located on or adjacent to an airport),
the TSA does not intend to inspect
such facilities, except (1) for compliance with security directives issued
by the TSA and with airport security
programs required by the TSA (for
those repair stations that are included
in an airport security program), and
(2) to respond to security information
provided to the TSA by U.S. or foreign government entities.

It is possible there is a constitutional argument that might be made
against the TSA audits. The most common legal argument in favor of such
searches - that the party has waived
the right to be free of such warrantless
searches in return for a benefit, like the
privileges of a repair station certificate
or access to a restricted area - is likely
to be ineffective because repair stations have acquired no new benefits or
privileges as a consequence of the TSA
security audits; instead they are merely
being permitted to retain privileges
they had before the rule and before the
statute underlying the rule.

Despite this potential constitutional
argument, the costs of raising this sort
of defense may outweigh the benefits,
so it may be best to cooperate with the
TSA in most visit situations.
What are security measures?
Repair stations that are required to
implement security measures will be
required to:
1. Designate a point of contact(s)
to carry out specified responsibilities.
