The shifting FAA paradigm
of 'Design Organization'
Could it affect you?

D

elegation has become quite
important to many Aircraft
Electronics Association
members. Both repair stations and
manufacturers rely on DERs (designated engineering representatives)
or ODAs (organization designation
authorizations) to approve technical
data. Delegation also is important to
the Federal Aviation Administration,
as it allows the FAA to leverage its
resources to accomplish more than it
could accomplish by itself. But delegation may be a disappearing paradigm,
as the FAA investigates the next paradigm for design approval functions.
There always is a congressional
concern over delegation. Congress
worries that the FAA is not delegating enough; thus, it is not adequately
leveraging its limited resources. But
Congress also worries that the FAA is
delegating too much; thus, it is shirking its safety responsibilities. This
dual-worry means that if Congress
were to intervene and make changes to
the statutes that permit delegation, then

it is impossible to predict which way
those changes could push delegation.
It is nearly impossible to quantitatively identify the "ideal balance" of
delegation; but even if it were possible,

There have been many shifts in
the FAA-industry relationships. In
the first half of the 20th century, the
U.S. government approved every
aircraft repair and alteration. After
World War II, the U.S. government
recognized this was not sustainable,

occurs with new technologies. For
example, when GPS was a "new
and unique" technology, the FAA
issued guidance in 1994 stating that
every initial GPS installation was a
major change in type design (requiring data approval in a supplemental
type certificate), and follow-on
installations were considered to be
major alterations requiring approval
of data through approved data
found in a type certificate, STC or
