TERMS & CONDITIONS The purchase of packages, air only and car rentals (hereinafter referred to as the “Services”) offered by NOLITOURS constitutes a contractual agreement between NOLITOURS and the customer and implies your acceptance of NOLITOURS’ Terms and Conditions described hereinafter in the sections “Things To Know Before You Go” and “Other Terms and Conditions”. Please ensure you read carefully and understand these Terms and Conditions prior to booking. THINGS TO KNOW BEFORE YOU GO FOR ALL SERVICES Unless otherwise indicated, all flights are operated by Air Transat. PRICES INCLUDE: Packages: Portions related to Services reserved, such as described in the pages of this brochure. • roundtrip airfare for Montreal, Quebec and Ottawa departures • car rental except for Disney packages • accommodation for the duration of the stay, in accordance with the vacation package and hotel category selected • services of a NOLITOURS representative at destination* • hotel taxes and service charges* (*unless you are otherwise advised) • wholesalers’ administration fees, GST and Provincial Sales Tax where applicable. For Services including a flight (package): navigation fees • other related taxes and fees • USA overflight fee • airport improvement fees for Montreal, Quebec and Ottawa • Canadian Air travelers security charge • airline insurance fee • GST and Provincial Sales Tax where applicable. Nightly hotel rates: Accommodation for the duration of stay, in accordance with the hotel category selected • hotel taxes and service charges* (*unless you are otherwise advised). Car rentals: Basic car rental for duration selected and any additional pre-purchased insurance. Attraction Tickets: Attraction ticket as selected • local taxes. All services: For Quebec residents, the contribution of $3.50 per $1,000 of purchased travel Services representing the customer’s contribution to the Fonds d’indemnisation des clients des agents de voyages (Indemnity Fund). PRICES DO NOT INCLUDE: Packages: Personal expenses • telephone and data port charges at some hotels • meals and drinks, unless otherwise specified as part of a vacation package • local taxes, airport fees and insurance on car rentals. Nightly hotel rates: Personal expenses • telephone and data port charges at some hotels • meals and drinks, unless otherwise specified as part of your hotel inclusions • car rental or airport/hotel roundtrip transfers. Car rentals: local taxes • airport fees • additional insurance. PROMOTION CONDITIONS “Book Early and Save” This offer may not be combined with any other offer and applies to the prices indicated in this brochure only. Savings are based on double occupancy. Payment conditions Regular deposit conditions apply at time of booking. Final payment must be received by the NOLITOURS office at least 45 days prior to departure or no later than the final date specified for the “Book Early and Save”. Please refer to hotel descriptions. Cancellation fees Refer to the “Cancellation charges” Please note that the days mentioned in the Terms and Conditions are normal business days and that the day of departure is not calculated for the purpose of the charges for changes. DEPOSIT At the time of booking, customers must provide the travel agent with a deposit as follows: Packages: A deposit of $300 per person is required at time of booking. Flights: A deposit of $100 per person is required at time of booking for Air Transat. Connector Flights: Full payment is required at time of booking. Nightly Hotel Rates: A deposit of $50 per room for hotel rooms • $400 per unit for condos/houses Car rentals: A deposit of $25 per car is required at time of booking. Attraction Tickets: Full payment is required at time of booking. These deposits do not include any amount paid for travel insurance. CHARGES FOR CHANGES Packages and flights: Any changes to a reservation (ex: date, hotel or room category) will be subject to the following charges: - 45 days and more prior to departure: $50 per person - 45 days or less prior to departure: refer to ”Cancellation charges” Car rentals: no fee Change in the room occupancy: If any change made by one or more customers alters the basis of room occupancy, rates will be adjusted to reflect true room occupancy status. Change in customer’s name: Changes of customer names will be treated as a cancellation and cancellation fees will apply. Changes made subsequent to departure date: Charges will apply for any changes in customer reservations subsequent to the departure date, as long as the changes are possible. More specifically, NOLITOURS’ representatives or the service supplier will charge customers the applicable fees. No refund will be given for a price change resulting in a lower fare. CANCELLATION CHARGES The following charges will apply to any cancellation, regardless of the cause: Packages, flights and “Book Early and Save”: - 46 days or more prior to departure date: deposit amount - 45 to 22 days prior to departure date: 50% of total package cost per person, including taxes and service charges - 21 days or less prior to departure date: 100% of total package cost per person, including taxes and service charges Connector Flights: 100% non-refundable Car rentals: At any time before the departure: deposit amount Cancellation to car rentals made after scheduled pick-up 5. FLIGHTS AND CARRIERS Customers acknowledge and accept the following: Changes: Flights offered by NOLITOURS are conducted in accordance with the applicable tariff of the air carrier and pursuant to regulations set out by the Canadian Transportation Agency. All such flights and rates are also subject to approval by the relevant government authorities. Consolidations and changes in the published schedule, aircraft type, days of operation, air carrier providing air transportation, and flight itinerary may be undertaken at any time and without prior notice, in accordance with the air carrier’s tariff. Schedule Check and Connecting Flights: Flight schedules are subject to change without notice. All customers having purchased a package or air only with NOLITOURS are entirely responsible for verifying the flight schedule with the airline and/or NOLITOURS’ representative during the 24-hour period immediately prior to the departure and the return date. Customers having purchased air only must reconfirm their return flight within 24 to 72 hours prior to the scheduled takeoff time. NOLITOURS undertakes to notify customers reasonably in advance through means it deems appropriate of any schedule changes resulting in the advancement or delay of the flight departure times or in case of cancellation of a flight. Whenever customers book connecting flights, they have the responsibility to allow themselves sufficient time to make the connection. No control can be exercised over air carriers to guarantee flight schedules, which may be altered or affected by various circumstances. NOLITOURS will not and no shows will be charged a minimum 1 day rental. There is no refund for any unused portion of a car rental. Hotel Accommodation: - 35 days or more prior to departure date: deposit amount - 34 to 4 days prior to departure date:50% of total package cost, including taxes and service charges - 3 days or less prior to departure date: 100% of total package cost, including taxes and service charges Condos/Houses: - 35 days or more prior to departure date: deposit amount - 34 days or less prior to departure date: 100% of total package cost, including taxes and service charges Attraction Tickets: non-refundable No refunds will be made by NOLITOURS for Services either cancelled or unused subsequent to departure. Insurance premiums are non-refundable, in whole or in part, whether cancelled before or after the departure date. All cancellation fees must be calculated based on the total amount of the products and Travel Services purchased including GST/PST. FINAL PAYMENT Unless otherwise indicated final payment must be received by NOLITOURS at least forty-five (45) days prior to the date of departure. Reservations made less than forty-five (45) days prior to the date of departure must be accompanied by payment in full. If final payment is not received within the required period, NOLITOURS reserves the right to cancel any such reservations without prior notice, without right of recovery for the client and levy applicable cancellation fees as indicated in this section of the Terms and Conditions. Airline tickets and other travel documents will only be delivered to the travel agent once NOLITOURS has received payment in full. Reservations made within fourteen (14) days or less of the date of departure are automatically assigned for pick-up at the airport or via e-document. It is the responsibility of customers and travel agents to ensure that the information appearing on the airline tickets, vouchers and other travel documents is consistent with booking arrangements. be liable for any change of schedule or a missed flight connection, including any additional fees incurred and special, incidental or consequential damages (including the carriage of baggage) arising from the foregoing, whether or not it had the knowledge that such additional fees or damages might be incurred. Airport check-in: It is recommended that customers arrive at the airport check-in counter at least three (3) hours prior to departure, failing which their reservation may be cancelled and their seats assigned to other customers, with no right of recourse. Seat assignment: Unless already pre-assigned, aircraft seating is conducted by staff at the air carrier’s check-in counter. In the event of the loss of confirmed Club Class seats available with some air carriers owing to a change of air carrier, aircraft type or because of flight consolidation, refund by NOLITOURS of the amount paid for Club Class service shall be deemed complete and final settlement.
