limitation placed on the companies relative to how far back they
can go. Certainly, six months or more is unreasonable. If it takes
an insurance company six months to discover their mistake, they
should eat the overpayment. I would think that six months after a
claim is paid should be a maximum time frame.
My suggestion to physicians is that we should have a communal
voice. In all our contracts, it should be stated that offsets should not
be done unless a given physician is not returning an overpayment
within sixty days from the time it is requested or for whatever
reason a given physician or group of physicians is satisfied with
the offset process. For the immediate future, physicians should
be aware of what is in their contract relative to the offset issue
and also communicate their wishes to any insurance company
that takes advantage of offsets to recover incorrect payments. We
must be proactive and communicate with the individual insurance
companies about issues that we consider unacceptable. lf we
communicate with the hierarchy of the insurance companies, and
they hear negative feedback from multiple physicians or a group of
physicians, this may motivate them to change their policies.
Finally, this is another example of why it is terribly important
that we have a collective voice. It will only be with strength in
numbers that we can deal with issues that need change. My
inclination is that the Pennsylvania Medical Society (PMS) is an
organization that truly represents us as well as providing multiple
valuable services. I believe that the PMS is aware of the offset issue.
Through our representatives, we should again present this issue to
the PMS to reinforce the importance of insurance companies having
too much power and continuing to take advantage of physicians.
I would encourage any PA physician who doesn't belong to PMS
to join.
