8. I was in another accident the day after this one. While it's
possible to represent someone in an injury case who's been
in two crashes within a short period of time, it can be a
nightmare proving which crash caused (or aggravated) their
back pain, neck pain, etc. Nothing against these clients, who
may have just been unlucky enough to get smacked twice in
succession. I just prefer to represent lucky people.
9. There was a big [name of foreign object] in my [name of
food or drink item], and I could have died! This kind of
call brings back memories of the guy who called me saying
that he'd found a plastic soda dispenser nozzle in his Coke at
McDonalds. Did he swallow it? Nope. Did he bite into it and
break a tooth? Nope. Did he choke on it? Ditto. At which
point I told him that he should be very happy he wasn't
injured by it. And that if he had died, I would have been
more than honored to represent his estate.
that said it was "Assumption of Risk" - and thus a complete
defense - to show that the plaintiff had knowledge that the
driver had been drinking. Since then, I have only accepted
passenger cases where the driver was Baptist or Mormon.

10. My friend who was driving was really drunk that
night. I got blindsided by this one during my very first
personal injury trial many years ago. After putting on an
overwhelming case that the driver of the car my injured
client was riding in was totally hammered that night,
opposing counsel (during his closing, when it was too late
to do anything about it) whipped out a Pennsylvania case
