Market law (Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty) whose provisions are clarified in a Commission Regulation (Commission Regulation (EC) No 773/2004 of 7 April 2004 relating to the conduct of proceedings by the Commission pursuant to Articles 81 and 82 of the EC Treaty). Since Regulation No 1/2003, European competition rules are applied by national courts, following the procedures stipulated in the Commission Notice on the co-operation between the Commission and the courts of the EU Member States in the application of Articles 81 and 82 EC (2004/C 101/04). Regulation No 1/2003 is currently the subject of a consultation by the Commission on its possible revision. The most important text on concentrations is Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (known as the EC Merger Regulation), whose provisions were clarified in Commission Regulation (EC) No 802/2004 of 7 April 2004 implementing Council Regulation (EC) No 139/2004 on the control of concentrations between undertakings. This body of rules is the subject of two series of guidelines: Guidelines on the assessment of non-horizontal mergers under the Council Regulation on the control of concentrations between undertakings (2008/C 265/07) and Guidelines on the assessment of horizontal mergers under the Council Regulation on the control of concentrations between undertakings (2004/C 31/03). Finally, several Commission Notices have been produced on specific points: Commission Consolidated Jurisdictional Notice under Council Regulation (EC) No 139/2004 on the control of concentrations between undertakings; Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004; Commission Notice on Case Referral in respect of concentrations (2005/C 56/02); Commission Notice on remedies acceptable under Council Regulation (EC) No 139/2004 and under Commission Regulation (EC) No 802/2004 (2008/C 267/01); Commission Notice on restrictions directly related and necessary to concentrations (2005/C 56/03); Commission Notice on the rules for access to the Commission file in cases pursuant to Articles 81 and 82 of the EC Treaty, Articles 53, 54 and 57 of the EEA Agreement and Council Regulation (EC) No 139/2004 (2005/C 325/07)). 281
