DRONES TAKE FLIGHT: Opportunities and Challenges REGULATION By Elizabeth Wharton, Esq. THE FEDERAL AVIATION ADMINISTRATION has released its long awaited rules for the operation of small unmanned aircraft systems, clearing county governments and private businesses for drone operations. Counties have long expressed interest in utilizing drone technology for aerial mapping, infrastructure inspections, search and rescue, and traffic management. The newly opened skies mean counties must navigate drone programs within the new federal rules, adjust existing ordinances and policies and implement necessary risk management precautions. Regulating the Skies Above Broadly speaking, safety and flight operations are subject to federal jurisdiction while 34 GEORGIA COUNTY GOVERNMENT privacy and local law enforcement drone uses fall to the states. Drones are considered "aircraft" under federal law and regulations and the FAA is tasked with regulating aircraft safety and operations within the "national airspace." See 49 U.S.C. §40102(a)(6), 14 C.F.R. §1.1; 49 U.S.C. §40103. Drones range from radio-controlled fixed-wing aircraft and helicopters to multi-rotor quadcopters. Emerging Federal Rules The FAA distinguishes three drone operation classifications: commercial, public entity (including federal/state/local government, law enforcement, or educational institution), and recreational. All drone owners, including hobbyists and counties, must register with the FAA if any drone aircraft weighs over 0.55 pounds. Owners of aircraft weighing between 0.55 pounds and 55 pounds may register online while a paper registration is required for aircraft in excess of 55 pounds. The one-time registration costs $5 and is valid for three years. Registrants must be at least 13 years old and a U.S. citizen or legal permanent resident. Once registered, an owner receives a registration number that must be visibly placed on all of their aircraft. Failure to register could result in fines and other penalties. After multiple year-long delays, the FAA released its final Small Unmanned Aircraft Systems Rule for drone operations in the national airspace in June. The rule, commonly referred to as "Part 107," took effect
