LEADERSHIP DEVELOPMENT Successfully Negotiating Service Delivery Strategy Agreements A new course offering in the Lifelong Learning Academy By Schuyler Harding ACCG Communications Manager ACCG OFFERED TO COUNTY officials a new course in the Intergovernmental Relations specialty track of the Lifelong Learning Academy. Taught four times in August 2016, the class focused on negotiating service delivery strategy agreements. It examined the history of service delivery and the requirements of the law, outlined strategies for preparing for negotiations, and focused on the leadership skills needed to negotiate a service delivery agreement that works for all citizens in the county. The class was held in AthensClarke, Toombs, Lee, and Bartow counties. Why Service Delivery? ACCG is always seeking ways to enhance the learning experiences of Georgia's county officials. It remains a priority for the association to provide its members with educational and training opportunities that they can take back to their counties to improve the quality of life for their constituents. The service delivery strategy negotiation class was created to do just that. The class was a result of a Lifelong Learning Academy design team recognizing a need to offer a course regarding the agreements that Georgia's county officials enter into with their city officials to determine who is responsible for specific services offered to their residents. Service delivery agreements have a significant role in county commissioners' abilities to efficiently and effectively provide services to their citizens, thus it was only fitting that the course be created. According to the Georgia Department of Community Affairs, the service delivery strategy process allows local governments, i.e., counties and their existing cities, to reach an agreement for the delivery of services in an effective and cost-efficient manner 78 GEORGIA COUNTY GOVERNMENT to Georgia's citizens. When considering the course, the design team outlined an overarching goal it wanted to achieve with the information provided in the class, namely to equip elected and appointed county officials with the tools and skills needed to assist them in negotiating the best deal possible with their city officials to ensure all county residents are treated equitably. During the introduction to the course, county officials in attendance were asked to describe their level of knowledge, rated on a scale of 1-10, with the latter being expert knowledge, regarding the service delivery negotiation process. While a relative few rated their knowledge as being fairly high, most indicated a need for instruction in the subject. Examining the History and Law of Service Delivery Strategy in Georgia The course began with a discussion of the history of service delivery strategy negotiations in Georgia. Attorney Larry Ramsey of Jarrard and Davis, LLP led the discussion and provided background on the law. Before 1972 there was a clear distinction between the responsibilities of cities and counties and what services they delivered. Counties were primarily responsible for roads and raising revenue for constitutional officers so that they could fulfill their official responsibilities. However, changing demand by citizens for higher levels of service did not remain aligned with that distinction. Dating back to World War II, citizens of unincorporated areas of counties began demanding services that residents of incorporated areas received. A change in state law in 1972 - constitutional Amendment 19 - established a baseline of services that cities and counties could provide while equalizing their service authority. It specified that counties could, for the first time, provide municipal services such as police, fire, trash, animal control, parks and recreation, and housing among others. The change also defined the jurisdiction in which the county and city were to provide those specified services. This was outlined in the Supplemental Powers Clause. Cities were authorized to provide services within city limits (incorporated areas) while counties would cover the unincorporated areas. Local governments were to abide by those provisions unless otherwise provided by law or unless the city and the county contracted, through an intergovernmental County officials that attended the Service Delivery Strategy Negotiation course were asked to describe their level of knowledge regarding the negotiation process.
