saying that the pursuit of legislative and regulatory revisions or "advocacy" is a
marathon, not a wind sprint? And have you thought -
where and when are we going to cross at least one of
these finish line(s)? I have some encouraging news
for you. There could be one or more finish lines in
our future before the end of the year!

Department will once again be called to make their
own determinations, and will publish them for public
comment through the NPRM process later this year,
with the ultimate goal being revised regulations once
again taking effect July 1, 2019.

Federal Negotiated Rulemaking

Congress continues to show signs that they intend
to complete the first set of changes to the HEA
since 2008. The House Education and Workforce
Committee has already completed mark-up of H.R.
4508 - The Promoting Real Opportunity, Success, and
Prosperity through Education Reform (PROSPER)
Act and is seeking House floor consideration of the
legislation as early as this month.
Meanwhile, the Senate Health, Education, Labor,
and Pensions Committee has completed their HEA
hearings, requested a final round of recommendations from the higher education community, and
announced publicly their intent to introduce the bill
in the early spring with a mark-up of the introduced
legislation shortly thereafter.
While it is always hard to predict Congressional
scheduling, the current plan is for the House to
take up full House consideration as early as this
month; the Senate to introduce their proposal by the
end of the month, mark-up their proposal in early
to mid-April (around the time of the AACS School
Leaders Summit and Capitol Hill Day), and proceed
to the Senate floor by May. This timeline would
set the stage for a House and Senate Conference
on the two proposals in the summer and a potential
vote on a final bill in late summer or early fall. The
next reauthorization of the HEA could be completed
this autumn and signed by President Trump before
the November mid-term elections.

Make a commitment to your students, school(s),
staff and industry by devoting time over the next
several months to actively immerse yourself into
public policy and advocacy.
AACS will be calling on our entire membership to
take action to promote the inclusion of our legislative priorities in the House and Senate bills, and we
will be calling on you to help us share our message
with Congress and the Department.

As this edition of Workings of Washington goes
to print, the first of two Federal Negotiated
Rulemaking Committees (Committee 1 - Borrower
Defenses & Financial Responsibility) has completed deliberations, and the second Committee
(Committee 2 - Gainful Employment) is preparing for their final, four-day session beginning on
March 12, 2018.
The Committee 1 negotiators failed to achieve
consensus on their list of eight Issue Papers, leaving the Department of Education to develop a set
of new proposed revisions to the existing Borrower
Defense to Repayment regulations and additional
regulatory revisions required based upon changes
to Accounting Standards. Without consensus, the
Department is left to determine which concepts
and recommendations they wish to incorporate into
their stated goals and objectives in modifying the
previous changes to the regulations.
While working on potential revisions to the BDR
regulations, the Department announced this month
(February 2018) that implementation of the previous
BDR regulations have been postponed until July 1,
2019. This delay provides time for the current negotiations, pending publication of a Notice of Proposed
Rulemaking (NPRM), and presumably the publication of a new Final Rule on or before November 1,
2018, to prevent the prior BDR regulations from ever
being implemented.
Similarly, while the outcome of the Committee 2
negotiations remains an open question, it is fairly
safe to assume that this Committee will also
fail to achieve consensus on yet a third round of
negotiations on how "gainful employment in a recognized occupation" should be defined and evaluated. Key opening questions are whether or not the
Department will maintain the positions outlined in
the previously presented Issue Papers suggesting
that GE be used not as a compliance provision to
determine certain programs eligibility to participate
in the FSA programs, but rather as a consumer disclosure required for all programs at all institutions
of higher education.
While the outcome is uncertain, the process
suggests that consensus will not be reached; the
