FROM THE EXECUTIVE DIRECTOR’S DESK The Shifting Landscape of Education Law By: V. Wayne Young, KASA Executive Director/General Counsel Looking Back: Lessons from History In 1896, the U. S. Supreme Court decided the case of Plessy v. Ferguson. In that landmark case, the court ruled that racially segregated “separate but equal” public facilities did not violate the U. S. Constitution. (Interestingly, the only dissenting vote in the 7-1 decision came from Justice John Harlan, a native Kentuckian who attended Centre College and Transylvania University). It took more than 50 years for the Supreme Court to overrule that unfortunate precedent. In 1954, in the famous case of Brown v. Board of Education, the court ruled that segregation in public schools and other public facilities did in fact violate the Constitution. Ten years later, Congress passed the Civil Rights Act of 1964, confirming and broadening the court’s ruling. This small slice of judicial history serves as a reminder that the law is fluid and evolutionary (and sometimes agonizingly slow). What is authoritative and precedential in an area of law today may be outdated and irrelevant tomorrow. In the school law arena, in my lifetime, we have seen significant changes brought about by the courts on matters such as school prayer, student free speech and special education, just to name a few. These kinds of fundamental shifts in legal matters affecting schools require school administrators and school attorneys to stay up-to-date on school law topics.
