The bill recognizes that
future administrations can
and should update the
overtime rules, as they
are required to under the Fair
Labor Standards Act, but
limits the ability of the DOL
to update the rules on autopilot.
On August 23rd, the final rule was then submitted to the Office of
Information and Regulatory Affairs Office of Management and Budget
(OMB) with USDA's comments and with a request from EPA to expedite
the review. We anticipate a final rule to be published in 60-90 days.
NPMA has been actively involved with EPA on the Certification and
Training rule. We will continue to monitor and provide information as
soon as it becomes available.
ZIKA FEARS PROMPT CHINA TO REQUIRE NEW
MOSQUITO TREATMENTS FOR U.S. IMPORTS
Following the World Health Organization's (WHO) August 2, 2016 determination that the United States is a Zika-infected country, Chinese authorities
now require mosquito disinsection for all U.S.-origin shipments to China.
Disinsection means killing live mosquitoes, their larva, and eggs. Fumigation
is one type of disinsection, but spraying is another method of disinsection.
On August 19th, NPMA participated on a stakeholder call facilitated
by the U.S. Department of Agriculture Foreign Agriculture Service (FAS).
FAS reviewed the new Chinese Zika treatment guidance provided by the
U.S. Embassy in Beijing following an August 18th meeting with China's
General Administration of Quality Supervision, Inspection and Quarantine
(AQSIQ's) Department of Supervision and Health Quarantine.
During the call, FAS officials highlighted two important areas very
pertinent to the pest management industry:
* Both individual cargo containers and the entire vessel must have a
certificate of disinsectation (one certificate confirming both will suffice)
* The certificate does not need to be completed by a U.S. government
agency, but must be completed by an authority recognized by the U.S.
government; specifically a licensed pest management company or a
licensed fumigator
On September 2, 2016 the U.S. Department of Agriculture Foreign
Agriculture Service (FAS) published revised guidance on China's mosquito
disinsection policy for all U.S.-origin shipments to China. AQSIQ stated that it
has decided to regionalize its Zika requirements for shipments of cargo from
the United States based on a risk-assessment performed by AQSIQ, using
data supplied by U.S. Centers for Disease Control and Prevention (CDC).
AQSIQ experts determined that due to the low risk of Zika transmission
through shipments of cargo, vessels originating from the United States,
other than the state of Florida, do not require disinsection certification. 	●
