Perfect Obamacare Repeal
Blocks Good Obamacare Repeal
T
here's an old saying that
you should not let the
perfect be the enemy of the
good.
But that's exactly what
happened in March when
President Trump and House
Republicans tried to repeal
and replace Obamacare,
a move that would have
fulfilled both a years-long
GOP goal and their top 2016
campaign promise.
Going into the debate with a solid House
majority but not enough votes to defeat
a Democratic filibuster in the Senate,
Republicans used a procedure known as
"budget reconciliation" that lets legislation
pass the Senate with a simple majority of
only 51 votes.
The catch was that budget reconciliation
can only address issues with a direct
revenue impact. Despite that, the bill
would still have achieved substantial
change. For example, the "employer
mandate" that businesses provide health
coverage for full-time workers would not
have been repealed outright, but financial
penalties for non-compliance would have
been eliminated, effectively achieving the
same goal.
In addition, the "Cadillac Tax" on highvalue plans would have been delayed to
2026 and the health insurance, medical
device and pharmaceutical taxes all
would have been permanently repealed.
The measure also would have increased
flexibility for health savings accounts and
would have taken a substantial first step
toward Medicare reform.
Nonetheless, members of the
conservative House Freedom Caucus
were not satisfied and demanded a more
complete repeal. The group refused to
yield despite a frenzy of vote whipping by
Republican leaders and being called to the
White House to meet with Trump.
The bill was twice scheduled for a vote.
But without conservatives' support, House

leadership canceled the vote
rather than risk having the
legislation voted down. And
after the second attempt,
the White House and House
leadership shocked both
supporters and opponents of
Obamacare by saying they were
abandoning the issue for the
foreseeable future and moving
on to other legislation.
After years of seeing
retailers suffer under the high
costs of Obamacare, NRF was disappointed
to see lawmakers give up so easily.
The legislation didn't do everything that
should have been done, but real reform
could have been achieved. By holding out
for a perfect proposal, Congress missed an
opportunity to pass realistic legislation that
could have become law.
Rather than quitting, it's time for
lawmakers to stop fighting and move
forward on reform that would actually
make coverage affordable for employers
and employees alike. NRF has been a
longtime advocate of true reform, but
Obamacare instead emphasized mandates
that only drove costs upward.
The good news is that House leaders
have begun trying again, offering additional
provisions to win conservatives' votes. The
changes that might make the bill appealing
to conservatives could, of course, draw
additional opposition from moderates and
Democrats. But even uncertain continued
talks are better than none.
There's another old saying - this one from
author Mark Twain - that we hope can soon
be applied to this legislation: "The reports of
my death are greatly exaggerated."
