D

uring a summer
evening at around
7 p.m., a female
patron had finished her swim at
a municipal indoor
pool facility. She
entered the women's dressing room and
had a shower. After leaving the shower in
her bare feet, she slipped and fell on the
floor just outside the shower area near
the floor drain. She struck the back of her
head on the floor when she fell. A witness
notified a lifeguard of this incident and

first aid was provided by this lifeguard
until the paramedics arrived and took
over. The claimant sustained a concussion along with soft tissue injuries.
The claimant's lawyer has pursued
a claim against the municipality and is
intending on commencing a court action
on her client's behalf. A Statement of
Claim has not been served against the
municipality as of yet.

Issues
1. Was the premises kept reasonably
safe?

2. Was the municipality liable for the
claimant's damages?

Analysis of the Claim
The indoor pool facility is owned and
managed by the municipality. The municipality is responsible for maintaining the
inside premises including the dressing
rooms. They rely on municipal staff to regularly clean and inspect the floor surfaces.
The municipality will be considered
the occupier of these premises as per
the Occupiers' Liability Act, R.S.O. 1990,
c. O.2, at the time of this incident.
