PRUNING REGULATIONS

W

hile Republican congressional leaders and the Trump
Administration sift through the wreckage of their bill to repeal and replace
Obamacare, and pivot to the equally
daunting task of tax reform, they continue to score wins reversing the tide of
overregulation. In fact, by the time this
column is printed, President Trump will
likely have signed ten Congressional
Review Act resolutions into law with
more on the way.
The Congressional Review Act (CRA)
gives Congress 60 legislative days from
when a major regulation is issued to
pass a resolution of disapproval. Before
President Trump took office, it was
last used to block OSHA's Ergonomics
Standard when a CRA resolution was
passed by a Republican Congress and
signed by President Bush in 2001.
A CRA resolution needs just 51 Senate
votes and Republicans now have 52,
so major regulations falling within the
60 legislative-day limit (back to June
2016) are ripe for repeal. In addition,
when a CRA resolution is signed into
law, agencies are barred from writing
a "substantially similar" regulation in
the future.
CRA resolutions are targeting virtually all federal agencies and, on March
27, President Trump signed H.J. Res.
37 repealing the Federal Acquisition
Regulation (FAR) council's and Dept.

of Labor's (DOL's) "Fair Pay and Safe
Workplaces" rule. Called the "blacklisting rule," it came from an Obama-era
executive order and required companies seeking federal contracts to disclose
violations, or accusations of violations,
of 14 federal labor laws. Notably, when
President Trump signed H.J. Res. 37, he
took the extra step of issuing an executive order revoking the original blacklisting executive order.
President Trump also signed H.J. Res.
83 in March, to repeal the Occupational
Safety and Health Administration's
(OSHA's) "Volks" regulation disobeying
a court ruling that the agency can't issue
citations for recordkeeping violations
beyond 6 months from the violation. In
addition to CRA resolutions, the rollback
of OSHA regulations will be boosted by
the Senate confirmation of R. Alexander
Acosta as Secretary of Labor.
Acosta has a strong background
in labor law, having been previously
approved by the Senate for posts including the National Labor Relations Board
and Assistant Attorney General for Civil
Rights in the Bush "43" Administration.
The sooner he gets his team in at DOL,
the better in order to deal with other
dubious OSHA regulations like delaying
the June 23, 2017 implementation date
for construction under the "Occupational
Exposure to Crystalline Silica" rule.

legislative-day limit, so pushing back
the starting date for construction to the
June 23, 2018 date for general industry
will allow time to dismantle it. This is
also true for OSHA's electronic reporting
of injuries and illnesses rule and its antiretaliation "whistleblower" provisions,
of which the Trump Administration has
already removed references to the rule
from OSHA's website.
Pruning regulations will be further enhanced by President Trump's
Executive Order installing "regulatory
monitors" in agencies to stop regulations
that burden the economy. This should
augment Labor Secretary Acosta's efforts
to curb DOL and OSHA regulations that
are out of reach for the CRA. o
