Future RFS Waivers EPA Provides Guidelines For Future Requests When the Environmental Protection Agency (EPA) ruled this summer on a request by Texas Gov. Rick Perry to reduce the Renewable Fuels Standard (RFS) by 50% in 2009, it generated new guidelines for future waiver requests that will require more analyses by those requesting a waiver. The Perry waiver request, asking that the RFS’ mandatory blending of ethanol with gasoline be cut from 9 billion gallons to 4.5 billion, ruled in August the request failed to meet statutory requirements because the EPA ruled the mandate would not cause severe economic harm. According to Karl Simon, EPA director of the Compliance and Innovative Strategies Division, “the waiver request gave us the opportunity to add some additional guidelines to the waiver requirements.” First Test of the Law Response No. 1101 Since the Texas waiver request was the first test of the RFS law and waiver procedure, there were no formal policies established for making such a request, Simon said. At first, the Texas request was just two pages long, he said. However, the Texas request generated more than 15,000 public comments to the EPA. “Texas did a good job in s u p p l em e n t i n g their original record as we went through this process.
