Seed Today - Q3 2008 - (Page 46) Class Action Status Sought in LLRICE601 Suit A lawsuit filed in Lonoke County, AR on July 2 claims that Riceland Foods Inc. was involved in development of LLRICE601 rice and delayed for months telling farmers that the GM rice had gotten into the food supply. The lawsuit was filed on behalf of as many as 4,000 Arkansas rice growers. LLRICE601 is not considered harmful to humans, but it had not been deregulated for human consumption. Riceland Foods, Stuttgart, AR, announced in August 2006 that LLRICE601 had entered the Arkansas rice crop. Japan, the European Union and other customers stopped importing Arkansas rice, which drove down the price farmers received. Attorney Paul Byrd who filed the lawsuit says if class status is granted, farmers who have not yet sued will have their claims protected. Hundreds of farmers across three states have already sued, usually targeting Bayer. Byrd’s state court lawsuit would be separate from those cases. Byrd says Riceland worked with Aventis to test the Liberty Link rice in Arkansas. Those plantings were to have been destroyed, but the strain mixed with other rice growing in the state and contaminated it. Byrd says Riceland knew in January 2006 that the strain had been detected in a shipment of rice to the European Union but withheld that knowledge until that August. tection Act (PVPA) by illegally selling AgriPro’s Jagalene wheat for seed. Federal law states that protected varieties may only be sold as a class of certified seed by authorized seed growers and dealers. In the Hoxie case, the producer had neither permission to sell the seed nor certification of that seed. “We take an aggressive stand against this practice by dedicating efforts and funding to prevent this theft,” says Greg McCormack, Regional Manager for AgriPro. “Our aggressive stand helps keep investment flowing into wheat research.” The law allows prosecution of all parties involved in the transaction—the seller, the buyer, the seed cleaner and any other parties.
