News MMS Close to Issuing Leases for Offshore T esting of Renewable Resources On July 9, the Department of Interior’s Minerals Management Service (MMS) issued proposed regulations that would govern development of wind, solar and ocean wave energy projects on the Outer Continental Shelf (OCS). In the Energy Policy Act of 2005, Congress authorized the MMS to issue leases for alternative energy development on the OCS. The OCS is an area extending 3 to 200 nautical miles from the Atlantic and Pacific coastlines. On the Texas and Florida shorelines, it is nine to 200 nautical miles. Cherise Oram, an energy facility permitting attorney for Stoel Rives, Seattle, WA (206-3867622), says the proposed rule would establish a program to grant leases, easements, and rights-of-way for alternative energy projects. “On the OCS, wind projects will need to obtain commercial leases from the MMS before they can move forward with commercial generation,” says Oram. “This will not affect wind projects that are completely within three nautical miles from the coastal shoreline.” According to Oram, the proposed rule would allow the MMS to issue leases that would permit data collection and technology testing for up to five years for limited leases, and for up to 25 years for commercial leases. “All leases would be subject to a competitive bidding process,” maintains Oram. “Leasees would be required to share revenues with the states.” On July 23, the MMS agreed to proceed with 12 limited leases under an interim policy it issued last year. Oram says limited leaseholders who want to conduct commercial activities will still need to apply for a commercial lease once the MMS’s proposed rule is finalized, which is expected to be at the end of the year.
