and trade fairs, being trained by a Canadian
company as well as training employees of a
Canadian branch of a foreign company. A letter of
employment indicating the need to enter Canada
is imperative in these cases.
A person may also apply for a TRP based
on humanitarian and compassionate grounds.
These usually include evidence that the applicant
has family in Canada and that the family of the
applicant will experience hardship if the applicant
is not allowed to enter Canada. In this case, married couples are more likely to be re-united than
non-married. It is vital to show exceptional circumstances, such as the birth of a child for instance,
that explain the applicant's necessity of a TRP. It
would also be a compelling reason if the applicant
can show that the applicant's family cannot visit
an applicant in the applicant's country due to visa
restrictions or health reasons.
There are also scientific and academic reasons
upon which a person may be granted a TRP. An
example of this is if an applicant needs to be
present in Canada in order to attend or present at
a professional conference or to conduct academic
research that benefits Canada's national interest.
III. More than 5 Years Since the
Completion - Criminal
Rehabilitation
If your client was convicted of a criminal offense
outside Canada and more than five years have
elapsed since the completion of their sentence,
your client may be eligible to apply for a Criminal
Rehabilitation.6
When reviewing a TRP application, Canadian
border officials have to ascertain that the likelihood of a security and safety threat is low if the
otherwise inadmissible applicant is to be permitted entry into Canada. Thus, prior to applying for
a Criminal Rehabilitation, a number of factors are
considered by border officials.
