has been convicted of these low level criminal
offences, they will be deemed rehabilitated after
5 years.
There is no specific application for deemed
rehabilitation. It is important to ascertain that an
individual is considered as someone whom Canada
would consider deemed rehabilitated. If the person
is not deemed to be rehabilitated by the passage
of time, they may be found inadmissible at the
border and subsequently denied entry. Deemed
rehabilitation can be assessed free of charge at a
Canadian embassy, high commission, or consulate.
V. Concluding Remarks
Special permission to enter Canada is a highly
complex legal process that may overwhelm your
client. First, it is crucial to determine the Canadian
equivalency of an offense committed abroad. It
does not matter how leniently or severely a given
crime is treated in the country where it occurred.
What is important is the gravity of the offense
under Canada's Criminal Code. This will determine the legal approach immigration attorneys
should take, as well as the processing times and
fees for your client's application. The government
does not simplify these applications. Further, it
is an offense for a representative, who is not a
member of a Canadian Bar Association, to receive
compensation for advice on an application to
the Canadian government. Your client would be
well-served to get assistance from an experienced
Canadian immigration lawyer concentrating in
criminality.
