ceives an applicant's criminal history record information file may consider both misdemeanor and
felony convictions "to the extent to which they relate to the applicant's suitability for employment
in the position for which he has applied."8 Moreover, with advances in technology and resources
available on the Internet, anyone, including employers and landlords, can easily perform an informal background check on an individual and
choose not to hire that person, or decline to enter
into a lease agreement with that person, based on
what they find on the Internet.9
The current expungement law in Pennsylvania
allows individuals to petition for an expungement
in limited circumstances. For example, individuals
who are charged with crimes and acquitted are
deemed automatically entitled to an expungement.10 Additionally, if the Commonwealth withdraws criminal charges or criminal charges are disposed by means of nolle prosequi, the court may
grant a petition to expunge those criminal charges
after balancing the harm to the individual charged
with the crime and the interests of the Commonwealth in preserving the records.11 The expungement law in Pennsylvania includes some options to
expunge certain convictions, such as the ability to
file a petition for expungement for summary convictions that are five years-old, and the ability to
expunge any conviction if the offender is 70 years
or older and has been arrest-free for 10 years, or if
the offender has been deceased for three years.12
Other than those two last options, offenders who
are convicted of misdemeanors have not had the
opportunity to expunge or conceal their past
crimes-until now.
In order to combat the severe impact on individuals with prior low-level misdemeanors and
the "continual barrier" they face when seeking
employment, Senator Timothy Solobay introduced
Senate Bill 1220 in the 2011-2012 session, and then
reintroduced the bill again in 2013 as Senate Bill
391.13 Senate Bill 391 proposed to expand Pennsylvania's expungement law to allow individuals to
