here is a statement that says, “All politics are local.” The same can be said, in most cases, for the law as well. Despite the number of overarching legal principles that inform our lives on the national level, in many cases the law can come down to more private relationships between two individuals or between an individual and an institution. In the last issue of Talking Stick, we addressed those legal relationships that exist between a college student and his or her institution as defined by federal constitutions as well as by federal and state statutory relationships. For this issue, we will investigate those legal relationships that are contractual in nature as well as those that arise out of torts. While private institutions are not required to conform to the guaranties of the Constitution absent state action, more often courts have defined the relationship between private institutions and the student as contractual. Public institutions, in addition to the requirements of conforming to the Constitution, also have a contractual relationship with students, as demonstrated in the case of Krawez v. Stans (306 F. Supp. 1230 [E.D. N.Y. 1969]). It is this contractual relationship that is especially applicable to issues that may arise for housing officers.
