of this catalog do not constitute a contract, express or implied between any applicant, student, or faculty member and The University of Texas at Arlington or The University of Texas System.” The court agreed that, in light of this statement, there was no enforceable contract between the student and the university (Tobias v. University of Texas, 824 S. W. 2d 201 [Ct. app. Texas, Fort Worth 1991]). Housing officers may want to consult with counsel on the advisability of including a contractual disclaimer in the residence hall handbook. Without such a disclaimer, a college or university will be held to the terms contained in its handbook or residence hall agreement or on its website. The Supreme Court of Illinois found that the Chicago Medical School had breached its contract with an applicant for admission when it failed to evaluate his application according

to the academic criteria published in its brochures and bulletin. The court said, “Here the description in the brochure containing the terms under which an application will be appraised constituted an invitation for an offer. The tender of the application as well as the payment of the fee pursuant to the terms of the brochure was an offer to apply. Acceptance of the application and fee constituted acceptance of an offer to apply under the criteria the defendant had established. . . . the application fee was sufficient consideration to support the agreement between the applicant and the school” (Steinberg v. Chicago Medical School, 371 N.E. 2d 634 [Ill. 1977]). The ins and outs of these contractual issues can be summed up rather simply in a phrase often used by Tom Miller, the longtime director of housing at Princeton University

in New Jersey: “Don’t promise anything you can’t deliver, and deliver everything you promise.”

THE DUTY OF CARE
Students can also have a relationship with their college or university as defined by torts. A tort is a civil, as opposed to a criminal, wrongdoing. This area of the law does not include breach of a contract, for which the courts will provide a separate remedy. In the case of torts, the remedy is designed to make the injured party whole again: that is, return them to the position they were in before they were physically, emotionally, or mentally injured. These reparations usually take the form of financial payments. There are many kinds of torts, but the most common one arising in college and university housing is negligence.
