The possibility of union organizing
by RAs comes at a time of increasing
activism and dissatisfaction among
students in general and select RAs in
particular. For example, RAs at Scripps
College in Claremont, California, went
on strike this past April to protest alleged lack of support from the college
administration after an RA's suicide.
Though not a strike to unionize, it is
emblematic of the activism that could
easily morph into union organizing,
particularly in an era in which unions
are eager to recruit new members and
increase their ranks, which have been
dwindling in recent years. According to
the United States Department of Labor,
the number of workers who belong to
unions has dropped from 17.7 million
in 1983 to 14.6 million in 2016. And
that number shows a drop of almost a
quarter-million workers from 2015.

the same way for
generations.
The road that led to this situation has been long and winding. And
things may still change, because decisions about whether student employees are entitled to unionize largely

depend on the political composition
of the National Labor Relations Board.
The NLRB (the "Board") is a federal
agency charged with administering
the National Labor Relations Act
(the "Act"), a law that governs labormanagement relations in the private
sector. (Public sector institutions are
not affected by the Board's decisions
because individual state laws regulate
union activity for public employees.)
The Board is composed of five members, three of whom are appointed by
the then-sitting president. NLRB decisions historically have flip-flopped on
critical issues depending on whether
Republicans or Democrats are in the
majority. This has been particularly
true for decisions regarding the status
of students.
