Pharmaceutical Executive Digest Europe - March 4, 2009 - (Page 1) News Landmark Lundbeck ruling good news for patent owners The UK House of Lords has ruled that Danish company Lundbeck’s product claims protecting its single enantiomer, or mirror image drug, escitalopram, are valid. The law lords have agreed with the Court of Appeal’s ruling that escitalopram could be protected by product claims, even though the only inventive aspect of the patent was the process of making it. The decision could have wide-ranging implications for the pharmaceutical industry and patent holders in general. It confirms that originators who find an inventive way of making a new product can obtain a monopoly covering it, all ways of producing it and all uses of it, if they disclose a single innovative way by which the product can be produced. Ewan Nettleton, a senior associate in the Life Sciences Sector Group at the law firm Bristows (UK), commented: “Companies that develop innovative process technologies will now feel on a more equal footing compared with those that concentrate on making innovative products. They will know that where their processes enable a new product to be made, they may obtain a monopoly covering the product and all ways of making it.” Escitalopram is an antidepressant drug in the selective serotonin reuptake inhibitor (SSRI) class. It is one of the two mirror image or ‘enantiomer’ forms that make up citalopram, escitalopram being the active form.
