Palm - Fall 2008 - (Page 23) ATO FO U N D ATIO N New Charitable IRA Opportunity The Emergency Economic Stabilization Act of 2008 offers you tax-free charitable giving this year and next. On Friday, October 3rd, Congress passed and the President signed legislation that extended provisions which allowed individuals over 70 1⁄2 years old to make tax-free gifts from their Traditional and Roth IRAs (Individual Retirement Accounts) directly to qualified charities in 2008 and 2009. Donors may make charitable distributions in any amount up to $100,000 each year, and couples with separate IRAs could each give that amount annually. Instead of being taxed for taking mandatory or unneeded IRA withdrawals, you might want to take advantage of this special opportunity to fund your charitable gifts. Individual Retirement Accounts are subject to income tax when withdrawn during your lifetime or by your survivors, and may also be subject to estate tax if left to individuals other than your spouse. Therefore, tax-free distributions from your IRA may be a very good way to support one or more of your charitable interests. Since tax laws and individual circumstances vary, you should contact your financial advisor about the best way for you to take advantage of this opportunity, and your IRA administrator to make charitable gifts directly from your IRA. But, to enjoy full benefit of this extended taxfree option, you must complete this year’s transfer prior to December 31.
