2012-17 Leasing Schedule

BOEM Offers Business-As-Usual Plan
WASHINGTON–The Obama administration is proposing to return to annual Outer Continental Shelf lease sales in the Central and Western Gulf of Mexico, along with offering limited access to the Eastern Gulf of Mexico and offshore Alaska, but nothing off America’s Atlantic or Pacific coasts. The more or less business-as-usual approach taken in the Bureau of Ocean Energy Management’s proposed 2012-17 OCS oil and gas leasing program generally was greeted with disappointment in industry circles, but was similarly condemned by environmental groups for proposing three lease sales offshore Alaska. Eric Milito, director of upstream and industry operations at the American Petroleum Institute, calls the plan, which was released Nov. 8 for public comment, “a missed opportunity to open additional areas that could have helped address rising energy demand, create American jobs, and reduce the federal deficit.” Donald Briggs, president of the Louisiana Oil & Gas Association, says, “Americans should have concerns that this plan . . . restricts access to a large majority of offshore resources.” He points out that in January 2009, the former Minerals Management Service under the George W. Bush administration proposed a 2010-15 leasing plan that included eight sales off the Atlantic and Pacific coasts that were canceled later by the Obama administration. “In this new plan, those resources (continue to be) off limits,” Briggs observes. Randall Luthi, who headed the MMS under President Bush and now is president of the National Ocean Industries Association, states, “This ill-conceived plan leaves us looking in the same area we have looked for (more than) a generation, and would cast our energy reliability and security lot to the whims of other, often unfriendly nations. While today’s decision is not unexpected, the lack of new access is deeply disappointing.” Luthi says NOIA is particularly disturbed by BOEM’s failure to propose any sales offshore Virginia, despite support for leasing by the commonwealth and its congressional delegation. U.S. Senator Jim Webb, D-Va., who says, “I am hopeful the administration will reconsider (including) Virginia in its five-year lease plan,” points out that he and Senator Mark Warner, D-Va., introduced the Virginia Outer Continental Shelf Energy Production Act of 2011 in July to encourage leasing off the state’s coast. In addition, seven of Virginia’s 11 U.S. representatives, led by Republican Bob Goodlatte, co-sponsored the Virginia Access to Energy Act last April (AOGR, May 2011, pg. 32). Comments NOIA’s Luthi, “As the Department of the Interior repeatedly has made clear, it would not be issuing new permits if it was not convinced that it could be done safely. If we can move ahead in the Gulf of Mexico to provide new energy and jobs to the nation, surely we can meet these challenges elsewhere in the OCS.” From the other side of the fence, however, Earthjustice attorney Holly Harris points to three lease sales proposed for offshore Alaska and declares, “Government scientists admit big gaps in what they know about the basic features of the Arctic Ocean. It is hard to imagine a responsible way to develop oil in this largely unknown body of water when we don’t understand what harms we need to avoid or how to avoid them.” Tailored Regionally BOEM Director Tommy Beaudreau says the 2012-17 proposed OCS leasing plan “recognizes the need to proceed carefully and in a manner that protects human safety, coastal areas, and the environment. This program both promotes responsible development and is informed by the lessons learned from the Deepwater Horizon tragedy and the reforms that we have implemented to make offshore drilling safer and more environmentally responsible.” Beaudreau adds that the proposed plan “reflects the need for a regionally tailored approach to offshore development that accounts for issues such as knowledge of resource potential, adequacy of infrastructure, including oil spill response capabilities, and the need for a balanced approach to our use of natural resources.” For example, BOEM says it is proposing annual lease sales beginning in fall 2012 for the Western Gulf of Mexico and in spring 2013 for the Central Gulf of Mexico, where supporting infrastructure, including subsea containment and oil spill response resources, are the most mature and well developed. Additionally, BOEM says it is proposing to hold sales in 2013 and in 2016 in the portion of the Eastern Gulf of Mexico that is not subject to a congressional moratorium that are “gauged to accommodate anticipated industry interest.” BOEM says it also is proposing one sale in 2015 in the Beaufort Sea, one sale in 2016 in the Chukchi Sea, and one sale in the Cook Inlet, “which initially is scheduled for 2013, but may be moved to later in the program, depending on industry interest.” BOEM calls the offshore Alaska sales “a balanced and careful approach to offshore development . . . that accounts for resource potential, environmental needs, and the social, cultural and subsistence needs of native Alaskan communities.” BOEM adds that the Beaufort and Chukchi seas sales are scheduled later in the schedule to facilitate further scientific study, allow time to analyze data collected from any exploration undertaken under existing leases, and to enable further planning and development of spill response preparedness and infrastructure. U.S. Senator Lisa Murkowski, R-Ak., praises BOEM for scheduling the Arctic sales, but cautions that “leasing is only half the story. The permitting process will be the determining factor as to whether these lease sales ultimately are successful,” she says. BOEM cites lack of oil and gas infrastructure as well as spill preparedness and response as reasons not to offer any Atlantic Ocean leases. It also points to “potentially conflicting uses, including those of the Department of Defense.” Instead, BOEM says it is moving “expeditiously to facilitate resource evaluation in these areas, including conducting a programmatic environmental impact statement relating to seismic surveys.” BOEM says it has not included any leasing off the Pacific Coast in deference to state wishes expressed in a 2006 agreement signed by the governors of California, Washington and Oregon. Lease Terms The proposed 2012-17 plan calls for a primary lease term of five years in waters up to 800 meters in depth, which can be extended for three years if a well is
