SGEIS Significant For New York Industry
By Del Torkelson AMHERST, N.Y.–A photograph of a well pad bordered by a fleet of dozens of hydraulic fracturing tanks dominated the program cover for the Independent Oil & Gas Association of New York’s annual convention. Over that photo stood a hopeful statement: “We’re Getting Closer!” However, before producers can extend the northern frontier of the Marcellus Shale play into New York, the state’s Department of Environmental Conservation must set forth the conditions under which operators will be permitted to employ the required high-volume stimulation technique. When IOGA NY gathered for its conference, held Nov. 8-9 at Amherst’s Buffalo Niagara Marriott, the DEC’s revised draft supplemental generic environmental impact statement on high-volume fracturing was slightly more than halfway through its scheduled 90-day public comment period. New York’s ability to join the ranks of states with thriving unconventional resource plays will hinge largely on the final SGEIS, numerous speakers emphasized. According to John C. Holko, IOGA NY secretary and president of Lenape Resources Inc. in Alexander, N.Y., an overbearing final SGEIS would discourage capital investment in New York projects. “Time is against us,” he suggested during a panel discussion dubbed “Arming the Oil Patch.” Barring a substantially different final version, Holko held that the SGEIS would hamstring operators with numerous unnecessary and onerous conditions. Therefore, he urged IOGA NY members to offer constructive critiques by the Dec. 12 deadline before the draft version’s flaws hardened into official policy, advising, “It is much harder to go back and change something than to change it at the beginning.” Joining Holko on the panel, moderated by IOGA NY Executive Director Brad Gill, were S. Dennis Holbrook, executive vice president and chief legal officer with Norse Energy Corp. Holdings Inc. in Buffalo, N.Y.; Roger Willis, president of Universal Well Services Inc., in Meadville, Pa.; and John A. Conrad, principal of Conrad Geoscience Corp. in Poughkeepsie, N.Y. Conrad also offered a separate presentation about some of the SGEIS’s provisions, a number of which he said misdirected risk management efforts. Other speakers with remarks on the SGEIS included Bradley Field, director of the DEC’s Division of Mineral Resources, and Heather Briccetti, acting president and chief executive officer of the Business Council of New York State. A legislative forum moderated by James Carr with Hinman Straub Advisors in Albany, N.Y. featured New York Assemblyman Andy Goodell, R-Jamestown, Senator Mark Grisanti, R-Buffalo, and Emmanuel L. Priest, deputy director of public affairs for Senator Thomas. W. Libous, R-Binghamton. Misplaced Priorities Conrad indicated the SGEIS originated in an effort to understand the risks highvolume fracturing could pose to New York. Unfortunately, he maintained, the greatest media attention focused on the most remote risks. “The deep subsurface has captured everyone’s attention and imagination,” he reflected. “The SGEIS certainly addresses those deep potential risks, but the most likely risks have much more to do with what goes on at the surface or–in some cases–at the shallow subsurface.” Conrad mentioned methane migration attributable to cementing and casing defects as one of fracturing’s shallow subsurface risks, but said the industry had long known to minimize those concerns. “While we cannot eliminate all problems from that process, we have come a long way and will continue to improve those techniques, tools and materials,” he related. “That leaves the majority of the potential risks and impact with what occurs at the surface.” The draft SGEIS recognizes fracturing’s surface risks, but its required setbacks and prohibitions mishandles them, he maintained.
