it will shut down all the state’s stripper wells,” he warns. Bender maintains that good regulatory policy toward hydraulic fracturing gets back to the fundamentals. “Good well construction protects the industry from most problems associated with potential contamination,” he emphasizes. “Accidents and surface spills will happen from time to time, but things down hole should be safe with proper cementing and casing.” Another issue with a national reach that Weinberg says would hurt Kentucky producers relates to efforts by the Obama administration and some in Congress to end oil and gas companies’ ability to deduct intangible drilling costs or percentage depletion. Advocates of eliminating those deductions often portray their effort as a fight against major, integrated oil companies, he notes, but the proposed changes to the tax code would have little or no effect on the big companies, but could be the last nail in the coffin for small independent producers. The Demand Side KOGA’s vision of its industry advocacy extends beyond efforts to protect and promote production, Weinberg says, noting that the association also hopes to influence demand by touting the benefits of vehicles that run on compressed or liquefied natural gas. “There are some opportunities with regard to LNG or CNG fueling stations,” he holds. “I look forward to KOGA finding an executive director who will take charge on that initiative.” Natural gas’s future role is a topic Weinberg says he mentions often. He acknowledges that demand growth’s impact on commodity prices tends to be gradual, but notes that it often is an enduring one. “I would like to see America take advantage of the abundance of natural gas in an effort to displace expensive foreign oil,” he offers. “It would help the state to take advantage of its resources.” Weinberg notes that Kentucky is one of only a few states without a commercial natural gas vehicle fueling station. “Getting the stations will take time,” he acknowledges. “If we can figure out a more efficient way to do it, it will bring down infrastructure costs.” He cites commercial delivery fleets in which vehicles hold to predictable daily routes and return to central locations as logical fits for NGVs. Nevertheless, Weinberg says KOGA must play a role in cultivating the markets most likely to grasp NGVs’ benefits. “It is most perplexing that we as a nation do not utilize our country’s inexpensive Btus,” he remarks. “More gas is being found every day. Why not take advantage of a resource this country already has?” East And West As he surveys the state’s oil and gas industry, Weinberg acknowledges that 2012 seems unlikely to appear on many Kentucky operators’ list of favorite years. Appalachia’s most popular drilling plays do not extend into the Bluegrass State, and natural gas prices’ ongoing lethargy has prompted many companies to pull in their horns. He notes that one of Kentucky’s bigger production companies announced early in the year its intention to severely curtail its drilling plans, and most other producers are drilling only the wells necessary to maintain leaseholds or meet other contractual obligations. Contractual obligations also come into play with regard to the gas Kentucky producers have on line, he continues. After years of grappling with pipeline bottlenecks, Weinberg says, many eastern Kentucky producers agreed to sell their gas on firm bases. In March and April, he reports, companies with firm capacity on the state’s dominant northbound systems were netting $0.33 an Mcf. “You cannot make money in that market,” Weinberg comments. “The biggest difference between this dip in the market and previous dips is the cost of getting gas to market. The larger independents have very high gathering charges and are not adjusting them for market conditions. For the smaller producers, having to pay $0.78 and 13 percent is hard to overcome. The company collecting the gathering charge is making more than the producer.” Nevertheless, Weinberg refuses to surrender to the doldrums. To the degree any eastern Kentucky companies have opportunities to use different systems, they also can build or acquire small stripping or refrigeration plants to derive an NGL bonus. He notes that Hayden Harper is attempting exactly that strategy, having acquired one such plant. Furthermore, Weinberg notes, Kentucky also includes its western producing province, which he says seems to be drawing increasing interest. “People are looking in that direction to try to find oilier opportunities,” he affirms. Bender suggests that only makes sense. “Kentucky was an oil state long before it was a gas state,” he observes. “The Illinois Basin is one of the country’s oldest oil producers.” But even with the increasing interest, he suggests that many viable drilling targets remain. “At $100 a barrel oil, there are reasons to go after those,” Bender ponders, “particularly horizontal redevelopment of mature fields.” He cites the example of a project in Henderson County, Ky., and estimates it
