and with an attorney general opinion. “The legislation, which can be considered again in the 2013 session, is intended to preserve the status quo while the Virginia Tax Department undertakes a study of issues surrounding gas and coal severance taxes,” Archer summarizes. “Legislators have instructed local government representatives to obtain commitments from their boards of supervisors to work to resolve the issue. Senator Puckett cautioned that, if the issue cannot be resolved at the local level, the general assembly will take control.” He adds that shortly after the end of the 2012 Virginia General Assembly’s regular session, one or more localities issued new property tax assessments that would result in tremendously increased tax bills for gas producers. “These assessments reflect a dramatic change in local taxation that puts the gas industry at risk,” he says. Archer says VOGA feels legislation may be necessary next year in order to provide reasonableness, uniformity and business certainty to local severance and property taxation. Among other legislation VOGA tracked on behalf of its membership this year, Archer mentions, were two natural gas infrastructure and energy efficiency bills that were high on the agendas of the association’s utility members. Both passed with strong legislative support as part of Governor McDonnell’s package of energy bills. Archer says the infrastructure legislation, labeled “NEED” (natural gas infrastructure expansion for economic development), permits a natural gas utility to construct facilities necessary for a qualifying economic development project, and to recover the costs in future rates. This bill was a key component of the governor’s energy agenda for 2012, Archer says. The energy efficiency legislation provides Virginia gas utilities with more flexibility in applying cost/benefit tests to potential customer efficiency programs. A bill placing a proposed constitutional amendment to restrict government-related eminent domain before voters in November was also of interest primarily to the utilities, Archer continues. He says the primary area of interest and discussion during the 2012 session was legislation that defined lost access and lost business profits, which are not included in the proposed constitutional amendment, and will be the basis for compensation to landowners in eminent domain cases. VOGA worked as part of a coalition to reach acceptable terms on this legislation, he notes. VOGA also supported an alternative fuel vehicle conversion fund for its longterm potential to create a source of funding to convert vehicles to run on compressed natural gas, Archer goes on. The legislation was enacted and signed by Governor McDonnell. “Energy issues affecting all aspects of the industry will continue to dominate the policy agenda in Virginia for the foreseeable future, and VOGA intends to have a significant voice in those discussions,” Archer comments. Drilling Landscape The state of Virginia produced 147 billion cubic feet of natural gas in 2010, which is equivalent to 26 million barrels of oil, according to VOGA’s Virginia Natural Gas Facts on the association’s website, www.vaoilandgas.com. Virginia ranks 18th in the nation for overall gas production and fourth in the nation for coalbed methane production. Rick Cooper, director of the Virginia Division of Gas and Oil at the Department of Mines, Minerals and Energy, is scheduled to present updated statistics to members during VOGA’s annual meeting technical program. “The drilling landscape in Virginia mirrored the rig count decline evident in many U.S. natural gas basins in 2011,” he reflects. “In Virginia, drilling has slowed in the past three-five years, in part because of gas prices hitting a 10-year low.” In March, Cooper reported, the state had 7,834 producing wells. “Our state has five counties where the majority of drilling takes place: Buchanan, Dickenson, Lee, Russell and Tazewell. But compared with the Utica and Marcellus, our area is not as active,” he adds. There were 757 new wells drilled in Virginia in 2010, but only 364 were drilled in 2011, Cooper contrasts. “We still have a lot of activity, it’s just not a lot of new activity,” he remarks. He says the Division of Gas and Oil issued 1,703 permits to drill either coalbed methane or conventional wells in 2010, which was an increase of 9.6 percent over 2009. “We now are seeing operators looking into drilling conventional horizontal wells, with a count of 82 in 2011,” Cooper adds. He points out that the division has only eight employees, including five field inspectors and two office staff. “Still, we are efficient, and review and process permits within 30-60 days so operators can start drilling operations,” he maintains. Regarding the possibilities for offshore exploration, Cooper says it is unlikely any drilling will occur offshore Virginia anytime soon. “We get a lot of questions about offshore drilling, but not permits,” he informs.
