open to possibly backing legislation that could promote natural gas-powered generation, but he suggests Bingaman’s bill faces a number of tall hurdles merely to emerge out of the chamber his party controls. “He is retiring at the end of the year, so I know he has been interested in trying to move some of this, but anything that happens in the Senate would have to be part of a much broader energy debate, even if the senator does not want it to be,” Naatz holds. He adds, “It is simply the nature of the Senate. Amendments would be offered and would open discussion on a broad range of issues, all the way from exploration in the Arctic National Wildlife Refuge to regulatory overreach. I do not think any move to pass something as a single, stand-alone shot will work.” Developments in March on legislation to expand incentives for natural gas vehicles suggest federal efforts to promote gas demand face suspicion not only from lawmakers skeptical of fossil fuels, but also deficit hawks and free market purists opposed to all energy subsidies. According to published reports, the Senate rejected 51-47 an amendment to its highway bill that contained provisions of the New Alternative Transportation to Give Americans Solutions (NAT GAS) Act. Meanwhile, HR 1380, the House companion bill, lost momentum and congressional sponsors as conservative groups, including Americans for Prosperity, Club for Growth and the Heritage Foundation, panned the bill as market manipulation. Published reports say the NAT GAS Act would extend by five years the tax credits for buying and manufacturing NGVs, with credits ranging from $7,500 for cars to $64,000 for heavy trucks. It also would create incentives designed to encourage fueling infrastructure construction. “Sometimes it can help a bill to gather a diverse coalition, but the NAT GAS Act ran into the reverse of that,” Naatz observes. “It is hard to say what the outlook for that is moving forward. A lot will depend on the election.” According to published reports, Senators Richard Burr, R-N.C., and Robert Menendez, D-N.J., indicated in mid-May that they planned to retool the legislation so it would garner more congressional support. Tax Shadow Menendez also has sponsored legislation that would eliminate federal income tax deductions for oil and gas companies, and early May saw another such bill, this time backed in the Senate by Bernie Sanders, I-Vt., and in the House by Representative Keith Ellison, D-Mn.

Naatz says IPAA actively resists such bills, but also judges them unlikely to pass during this Congress. The greatest risk to the oil and gas industry’s deductions, he suggests, comes not from stand-alone legislation, but efforts to find revenue offsets to balance other spending. This is true, he says, despite the fact elected officials continue to cast such efforts as deficit cutting. “I am not being glib about billions of dollars, but in the overall scheme of balancing the budget, it is not going to happen as the president describes,” Naatz relates. “The bugaboo we have to watch for is efforts to use the tax provisions to pay for other activities.” Even that seems relatively remote before the first Tuesday in November, he says. After that, he says, anything goes–and perhaps even before the new slate of elected officials takes office. “All of us in the industry–and country–need to watch the lame-duck session at the end of this year, which probably will be one of the busiest lame ducks I ever have seen,” Naatz forecasts. “The Bush tax cuts are scheduled to expire, Congress may have to deal with the debt ceiling, and I have a hunch it will have to pass some kind of budget or appropriations, which will raise some very tough tax questions. Those will wrap both positively and negatively in legislation affecting energy.” Furthermore, he reports, word around the Capitol indicates both parties want to tackle tax reform in the next Congress, and they want to “go big” when they do. “Democrats, Republicans, everybody is on board,” Naatz concludes. “How that is written will be the million dollar question, but there will be a serious look, and IPAA needs to make sure people understand it does not take too many bad decisions on that type of bill to seriously jeopardize the people we represent. That means we have to talk to people now for a fight 18-24 months away. If we do not, we will be in trouble because tax reform will be a serious battle.” Ì
