McNeill and (Associate Director) Astrud
Masterson, and some very experienced
board members, I have been blessed with
people who make my job easier. It looks
like it should continue because we have
a great slate of folks joining the board."
Maurice Royster, KOGA's presidentelect, points out this is an election year
for Kentucky, and the association is
scheduled to have the Republican and
Democratic gubernatorial candidates address the annual meeting during the breakfast session on Thursday, July 16. Royster,
manager of government affairs for EQT
Corp. in Pittsburgh, adds that while Jack
Conway and Sannie Overly easily captured
the Democratic slot for governor and
lieutenant governor in the May 20 primary,
the Republican picture is not as clear.
In early unofficial results, the Kentucky
Board of Elections reports Matt Bevin and
Jenean Hampton held an 83-vote lead over
James Comer and Chris McDaniel, out of
214,187 votes cast in the GOP primary.
Royster says none of the gubernatorial
candidates have expressed a serious antiindustry stance during the campaign. Conway, the state's attorney general, has
demonstrated strong support in the producing counties of eastern Kentucky, he
points out, adding, "From the industry's
standpoint, I don't think there is a loser
here. It is a win-win either way for us." ❒

Ninth Requirement
The federal notice proposes a ninth
requirement (proposed paragraph (b)(9))
that would apply only to petitions to the
USFWS seeking to add a species to the
endangered list, change the status of a
listed domestic species, or designate or
revise critical habitat for any species
under ESA jurisdiction. The proposed
revision covers communications among
petitioners, the state agencies responsible
for managing and conserving species in
each state where the subject of the petition
occurs, and USFWS.
Generally, the federal services say,
states have jurisdiction and responsibility
for managing and conserving freshwater
fish, wildlife, and plant species not listed

as endangered or threatened under ESA.
As a result, they have developed substantial
experience, expertise and information
relevant to species conservation.
ESA already recognizes and acknowledges the states' individual experience
and expertise, USFWS points out. As
one example, it cites the section of the
act that directs the secretary of interior
to cooperate on ESA issues with the
states to the maximum extent possible.
The act also directs the secretary, when
making listing determinations, to take
into account the efforts made by the
states to protect a species. When going
against a state conservation agency's recommended action, the secretary must
provide written justification.
Under the proposed change, all petitioners seeking ESA changes must certify
that they submitted copies of their petitions

to every state's conservation agency where
the species occurs. If the agency provides
data or written comments regarding the
accuracy or completeness of the petition,
those must be submitted as well.
Comments about the proposed ESA
changes may be made electronically or
through hard copy. All comments, including personal information, will be
posted on www.regulations.gov. Using
the federal eRulemaking portal at
www.regulations.gov, comments may be
