KIOGA also is actively opposing another instance of federal overreach by
joining comments submitted to the Pipeline
and Hazardous Materials Safety Administration. Cross says the Kansas group is
working with IPAA and 11 state oil and
gas associations to oppose the agency's
attempt to extend its gas gathering authority to the wellhead (see story, pg.
110).
According to the comments submitted
July 7, the agency is claiming that the
existing framework for regulating gas

production and gathering lines no longer
is appropriate because of unconventional
gas development, and conflicting and
ambiguous language in API's Recommended Practices 80.
In their comments, the associations
assert the Natural Gas Pipeline Safety
Act of 1968 limits PHMSA's authority
to facilities used only for transmitting
and distributing natural gas, as well as a
limited group of gathering lines. The
comments argue Congress notably excluded facilities used to transfer gas
during production operations.

"The associations want to restrict the
government's overreach into production
operations," Cross says. "The government
wants to redefine what constitutes a production operation so it can extend its gas
gathering line regulations all the way to
the wellhead. The associations think that
authority ignores PHMSA's jurisdictional
constraints.
"There is a chance those regulations
will be issued this year," he says. "I think
a lot of the agencies are trying to issue
those regulations before President Obama
leaves office."
