KOGA Has Banner Year
In Kentucky Capitol

FRANKFORT, KY.-Although Kentucky's oil and natural gas activity has
been slow to recover from years of lackluster commodity prices, the state's industry trade group continues to see success
with a legislative and strategic communications agenda that emphasizes preparation, advocacy and collaboration, the
group's leadership reports.
Kentucky Oil & Gas Association President Maurice Royster, manager of state
government affairs at EQT Corp., in Pittsburgh, stresses the importance of building
strong coalitions, attracting new association
members and enhancing the communications
strategy to counter the growing resistance
of well-funded environmental groups.
"During these contentious times, producers and companies cannot afford not to
be members of the association," Royster
emphasizes. "Membership is at its strongest
point when we have a unified voice fighting
for the needs of the industry. Having a
robust communications strategy and legislative agenda bolsters our ability to deliver
a quality product for our members."
As KOGA regains its footing, the
group's top legislative priority sailed
through this year's legislative session
while a trio of bills that also had its
backing proved successful, says Executive
Director Ryan Watts. "We had a banner
year in the Capitol," he assesses.
Royster attributes the association's
string of legislative successes to the hard
work of the Oil and Gas Workgroup,
which was formed under the previous
gubernatorial administration to address a
variety of oil and gas issues in Kentucky.
"It spends countless hours crafting
good public policy on the front end to
ensure there is minimal work left when
the bills go through the process," Royster
says. "We have gone through three sessions, and each time our bills move with
little or no opposition."
KOGA's legislative success will be
among the topics up for discussion at its
annual convention, scheduled for June
12-14 at the Embassy Suites, in Louisville.

will include sessions on cybersecurity, a
legislative recap, state and federal regulatory updates, and a look at midstream
activities and other industry issues.
"It is important that when our members
attend our conference, they are assured
that we care and value their interests,"
Watts observes.

KOGA's statehouse agenda saw success
while the state's elected representatives
wrestled with knotty issues such as the
budget, tax reform and teacher pensions,
Watts points out. Only days before the session's scheduled conclusion, Governor Matt
Bevin signed controversial teacher pension
reform legislation and then vetoed a state
budget bill and a related bill on tax reform.
"If we are going to do tax reform-and
we need to do tax reform-it needs to be
comprehensive," Bevin is quoted.
"KOGA continues to monitor these
issues to ensure our members are protected
from future tax liability," Royster adds.
Poster Child
KOGA is thoroughly satisfied with
the results of the 2018 Kentucky Legislature, Watts indicates. "Our flagship bill
passed unanimously on both sides of the
Capitol," he notes. "When you consider
ours was only one out of 1,200 bills and
resolutions introduced this year, it has to
be considered a big success."
Intended to streamline and clarify the
state's shallow well hearing process, SB
249, sponsored by Senator Jared Carpenter,
R-Berea, is a "nuts and bolts" approach
to resolving development issues that can
slow projects, Watts characterizes. Notably,
the bill moves hearings for shallow wells,
coal beds, and pooling and royalties to
the Energy and Environment Cabinet's
Office of Administrative Hearings. It was
drafted by representatives of the EEC,
KOGA, the Kentucky Resources Council
and other work group members, he says.
Formerly, the state's Division of Oil
and Gas was housed in a different cabinet,
he notes. There, oil and gas hearings were
managed through a process defined under
KRS Chapter 13B which, Watts describes,
"lends itself to creation of red tape and
hearings conducted by hearing officers
with little subject matter expertise.
"With passage of SB 249, oil and gas
hearings will follow a hearing process
that is legally consistent with most other
cabinet program hearings," he adds.

the division for an OAH hearing when
parties cannot agree on well location;
