Kansas Oilmen Win Some,
Lose Some At KCC

WICHITA, KS.-Win some, lose some
may be a good way to describe how the
Kansas oil and gas industry has fared in
a series of developments this spring at
the Kansas Corporation Commission, indicate leaders of the Kansas Independent
Oil & Gas Association.
KIOGA definitely was pleased with a
regulatory interpretation establishing a
"direct and substantial interest" requirement for protests at the commission, say
KIOGA President Ed Cross and Chairman
Kenneth White, as well as an order upholding numerous injection well permits.
Less pleasing, they acknowledge, was
a KCC order increasing the Oil & Gas
Conservation Division's Conservation
Fee Fund assessment by 58 percent, although even that carried some positive
ancillary concessions.
Meanwhile, as they prepare for the association's annual convention, Aug. 12-14
at the Century II Convention Center in Wichita, White and Cross say they are hopeful
for some breakthrough on the KCC's orphan
well policy, even while KIOGA seeks fairness in analyzing the causes for earthquakes
this spring in the Hutchinson, Ks., area,
and the association prepares to oppose a
possible tripling of filing fees at county
register of deeds offices.
Injection Wells
Cross notes that the precedential order
on standing written by Chairwoman Shari
Feist-Albrecht was formally adopted by
the KCC on April 5. The order holds
that, for their protests filed with the commission to be considered valid, each individual protestor must show he suffered
cognizable injury, and that there is a
causal connection between the injury and
the conduct being challenged (AOGR,
June 2016, pg. 117).
Although the order certainly hasn't
ended objections to oil and gas permit applications, White, who is president of White
Exploration in Wichita, points to a June
evidentiary hearing on two pending injection
well applications in Douglas County, Ks.
"The precedential order was used to elim-

inate quite a few protestors who truly did
not have standing," he relates.
Cross says he believes the order's fingerprints also can be found in a recommendation filed by KCC staff on June 22
that the commissioners dismiss a petition

to nullify nearly 1,000 injection well permits granted since Oct. 24, 2008. That
was the date the commission extended
the period in which someone could object
to an injection well application from 15
to 30 days. But because the requirement
