demonstrate his performance as evidence
of his medical qualiﬁcation. He performed
beautifully. The judge ordered the FAA to give
him back his certiﬁcate. The FAA refused.
The FAA appealed the judge's decision to
the ﬁve-member, politically appointed board,
with full knowledge of the pro-FAA bias of
the board as it was then constituted. The
NTSB-considering only the written record
before the judge, never personally hearing
any of the witnesses or seeing Hoover ﬂy his
trial demonstration, and from behind closed
doors-reversed the judge. Appeals to the
courts predictably failed. What judge would
overrule an "expert" agency that pronounced
public safety required Hoover's grounding?
Even though he lost in litigation, Hoover
never gave up. Then, in 1995, a courageous
FAA administrator returned him to flying
status. Hoover continued ﬂying his performances, proving the falsity of the FAA's claims.
Hoover's grounding proved to be unjustiﬁed. The problem was that there was no
effective way to challenge an immediate
grounding. AOPA and the Experimental
Aircraft Association, and other aviation organizations, sought legislation to allow some
independent review of the FAA's exercise
of its emergency powers, and by an agency
expert in aviation safety. No one challenged
that the FAA should have these emergency
powers, only that there should be due process
to prevent abuse. The "Hoover bill," championed by Sen. James Inhofe of Oklahoma and
others, became law in March 2000.
Under the Hoover bill, a pilot who is
immediately grounded on an emergency
basis by the FAA can immediately appeal
the emergency aspect to the NTSB. The
NTSB will promptly review it. If the board
ﬁnds that an emergency does exist, justifying
the grounding, the grounding stays in effect
while the pilot pursues the NTSB appeal of
the FAA's allegations. If the NTSB ﬁnds that
the grounding is not justified, the pilot is
restored to ﬂying status while the pilot prosecutes his appeal on the merits. Even under
this law, a pilot could be grounded for ﬁve
or more days before the board reverses the
grounding. Nevertheless, this is quite an
improvement. The result of the Hoover bill
is that the FAA is much more judicious in
bringing emergency cases. And, I believe, it
should be recognized that this improvement
is directly attributable to Bob Hoover. AOPA
