After the case, he orders a battery of blood tests. The result is positive for hepatitis C. Does he have an obligation to report the infection to his medical group and/or to the hospital surgical department head? Does he have an obligation to inform his active patients? To these questions, we received this response from an anonymous reader: “In my opinion, the surgeon has an obligation to inform the patient on whom he was performing the surgery as the patient may or may not be aware he has Hep C. He should report the incident to the hospital department head as required by the hospital’s protocol. “I don’t think that he needs to inform his active patients, since it’s transmitted by blood. Usually during the surgery, there is a concern that a needle that you already passed through the patient, who may or may not have the disease, could stick you. Not the other way around.” Do you agree? Share your answer to this or previous Ethics Scenarios by e-mailing pstresky@apma.org. Your response may be printed in an upcoming issue of Your APMA. Requests for anonymity will be honored. http://www.apma.org/thenational http://www.facebook.com/TheAPMA http://www.youtube.com/user/TheAPMA
