resident Obama and Congress are focused on the national deficit and debt, but what does this mean for ASHRAE and
the building industry? While it’s only possible to speculate until Congress and the president approve actual numbers, here are two scenarios that are considered to be likely:
scenario 1
Federal funding is frozen for the next five years. In his State of the Union address, the president announced that in his budget* request to Congress he would propose freezing annual domestic spending for the next five years. Right or wrong, the practical implications of this less than likely scenario are that the government would be stretched in its ability to engage in many new or expensive initiatives, and a strong emphasis would be placed on high-impact, low-cost programs. The size of the federal government is an issue outside the scope of ASHRAE’s mission “To advance the arts and sciences of heating, ventilating, air conditioning and refrigerating to serve humanity and promote a sustainable world,” and, therefore, ASHRAE does not take a position on this matter. and priorities receive increases, while others receive cuts or are eliminated, it may become significantly harder for Congress to pass any bills. This may include spending (technically “appropriations”) bills and tax bills, as well as bills that only allow (technically “authorize”) funding for new and existing programs. Bills that contain equal or greater cuts to other programs may have an easier chance of passage; however, the prospect of cuts is often challenging in Congress, as many programs are supported by vocal constituencies. The potential for increased difficulty of passing authorization bills would be a departure from current practice, in which it is sometimes easier to pass these bills, since most don’t force the government to actually spend money. With Congress almost completely gridlocked under this scenario, where might we expect to see the most action in the building industry? The answer lies in the states, federal agencies, and private sector. Although many remain financially strapped, states will have a big role to play. States such as California, Massachusetts, and others are aggressively moving towards greater building ef-

f iciency through new requirements, voluntary programs, and stakeholder education campaigns. Other states are keeping a close watch on these efforts, and seeking to learn lessons from their experiences. Federal agencies will also continue carrying significant influence in the building industry. Through the Federal Register, agencies collect information and propose rules on all subjects and building aspects. The federal government issues hundreds of rules each year (many of which ASHRAE submits comments on), and each rule carries the force of law. It almost goes without saying that ASHRAE and the rest of the private sector will also continue as leaders in the building industry through research, standards and code activities, as codes are a relatively low-cost means of encouraging change. All of this doesn’t mean that Congress should be completely counted out. Very low-cost initiatives will take precedence; this includes proposals that seek to increase transparency and educate the public and other stakeholders about buildings’ designed and actual performance through building labeling programs. We have already seen support for such proposals in the previous congress through bills including the American Clean Energy Leadership Act and the American Power Act. ASHRAE is working with members of Congress and their staff to introduce similar legislation in the current Congress.
