"With the proliferation of ransomware and spear phishing, confidential customer information is seriously at risk," Erzen said. "The costs
of a data breach are high. When you
combine IT forensics, legal bills,
and data restoration costs, rarely is
it under $50,000 and it can be multiples of that."
This cyber liability insurance
coverage is specifically designed to
protect a business or organization
from liability claims:
■■ involving unauthorized release
of information which the organization was legally obligated to
keep private;
■■ alleging invasion of privacy and/
or copyright/trademark violations in a digital, online, or social media environment; or
■■ alleging failures of computer
security resulting in deletion/alteration of data, transmission of
malicious code, denial of service,
and the like.
The policy covers defense costs
in state or federal regulatory proceedings involving violations of
privacy law and provides expert
resources and monetary reimbursement to insured BGAs for out-ofpocket expenses associated with
appropriate handling of such incidents. Those expenses could include
hiring a public relations consultant,
IT forensics, customer notification
and credit monitoring, and attorney's fees. Even though the term

"cyber" implies coverage is only for
incidents involving electronic hacking or online activities, this product
also covers private data and communications in many formats-paper,
digital, or otherwise.
The policy for NAILBA members
also covers cyber extortion, also
known as ransomware, if a firm's
computerized information is stolen and held for a cash ransom.
"Although no one likes to pay these
cyber criminals off, in some instances that is what is required and the
policy would pay on the BGA's behalf
for those costs," said Erzen.
