Pollution Engineering - September 2008 - (Page 66) StateRules 4 2 7 6 1 5 3 ARKANSAS – PIT GENERAL PERMIT MODIFIED The Arkansas DEQ is in the process of making changes to the general permit for constructing, operating, and oil and gas well exploration pits.Theses pits are used for the temporary storage of drilling muds and fluids. They are closed after the well has been drilled and are not to be used for storage of the hydraulic fracturing water, completion fluids, or other oilfield wastes. IOWA – STUDENTS DEVELOP NEW LEGISLATION Gov. Chet Culver has signed two bills into law that were developed by middle school students as part of an environmental science project. House File 2668 mandates that sellers of oil or oil filters at state retail establishments accept used filters from customers at the point of sale, or post notices of locations where customers may dispose of used oil and used oil filters. A business that generates used oil filters or collects the filters may not dispose of the filters in a sanitary landfill and must recycle the filters. 1 4 COLORADO – DENVER AREA EMISSIONS TESTS STRENGTHENED Those whose car or light duty truck requires an emissions test should be prepared for more stringent requirements in the seven-county Denver metropolitan area. The Colorado Department of Public Health and Environment established new standards for passenger vehicles, which took effect on May 5, 2008. The pass/fail standards for biennial inspections for passenger vehicles aim to reduce ground level ozone pollution along Colorado’s Front Range. ing individual sewage treatment and disposal systems. Effective May 9, 2008, the amendments include updates in technology, clarification of site requirements and system requirements. Amendments also incorporate construction standards and changes in the administrative appeals process. More than 60 new definitions have been added to the regulations. Since the last revision in 1986, there have been numerous changes in the technologies of design and installation of onsite wastewater systems. The regulation has been completely rewritten to incorporate the extensive changes. 2 MISSISSIPPI – UST AMENDMENTS ON THE HORIZON The Mississippi DEQ is in the process of updating state UST regulations to implement the federal UST Compliance Act (USTCA) that was part of the Energy Policy Act of 2005. The DEQ was under a mandate to begin the implementation process by Senate Bill 2376, which was signed by Gov. Haley Barbour earlier this year. The USTCA focuses on preventing releases. Among other things, it includes provisions regarding inspections, operator training, delivery prohibition, secondary containment and financial responsibility, and cleanup of releases that contain oxygenated fuel additives. WEST VIRGINIA – UST REGS UPDATED The West Virginia DEP has updated its underground storage tank regulations, in part to incorporate changes mandated by the 2005 federal UST Compliance Act. The DEP has adopted new requirements for secondary containment with interstitial monitoring for new or replaced USTs or piping. States that receive federal UST funding have the option of implementing the secondary containment grant guidelines or financial responsibility and certification grant guidelines. 5 7 FLORIDA – DEP REVISES EMISSIONS REPORTING The Florida DEP Division of Air Resource Management, , plans to revise annual reporting requirements for air pollutant emissions from permitted facilities. The revisions update the Annual Operating Report (AOR) form to include emissions computation and reporting requirements, and to modify other air emissions reporting procedures.
