For example, chlorine, normally used to disinfect drinking water, can react with some pharmaceuticals, rendering them toxic. notice of proposed rulemaking (ANPR) soliciting public comments on how to respond to the U.S. Supreme Court’s decision in Massachusetts v. EPA. In that case, the court ruled that the Clean Air Act (CAA) authorizes regulation of greenhouses gases (GHGs) because they meet the act’s definition of “air pollutant.” In view of the potential ramifications of a decision to regulate such gases, the notice reviews the various CAA provisions that may be applicable to regulate GHGs, examines the issues that regulating the gases under which those provisions may raise, provides information regarding potential regulatory approaches and technologies for reducing such emissions, and raises issues relevant to possible legislation and the potential for overlap between legislation and CAA regulation. The notice also describes and solicits comment on petitions the EPA has received to regulate GHG emissions from ships, aircraft and non-road vehicles such as farm and construction equipment. Finally, the notice discusses several other actions concerning stationary sources for which the agency has received comment regarding the regulation of GHG emissions. Comments are due by Nov. 28, 2008. EPA Proposes GHG Rules On July 30, 2008, the EPA issued an advance Risk-Based Priorities for More Chemicals The EPA has posted risk-based prioritization and supporting documents for 26 chemicals that were sponsored under the HPV Challenge Program (visit http://iaspub.epa.gov/oppthpv/hpv_hc_characterization.get_report?doctype=1). For a given chemical or chemical category, each prioritization presents an initial recommended level of concern based on information in the supporting documents, which include a hazard characterization, exposure characterization and risk characterization. The agency uses these screening-level documents to evaluate chemicals and assign initial priority for future potential action based on the risk concerns presented by these chemicals in comparison with other HPV chemicals and in light of any uncertainties presented by gaps in the available data. The documents are primarily based on hazard, use and exposure data available to the EPA through the HPV Challenge Program.
