Under the Clean Trucks Program, drayage truck owners are to have access to port-sponsored grant or loan subsidies to scrap and replace polluting trucks working at the ports. 1 amendment, the department has adopted a policy that will allow generators of F019 waste to comply with the federal version of the rule under certain conditions. F019 is the wastewater treatment sludge that is generated from the conversion coating process for aluminum parts for motor vehicles. claims that the current fees are insufficient to cover the costs associated with the program. TEXAS – COMPLIANCE DURING A SEVERE WEATHER EVENT The Texas Commission on Environmental Quality (TCEQ) recently released guidance concerning compliance with air rules during severe storms such as Hurricane Ike. According to Texas officials, the best approach is to directly contact a TCEQ regional office. If that is not possible, stationary sources must apply best engineering and good pollution control practices to minimize emissions. 8 CONNECTICUT – $4M FROM CO2 AUCTION Gov. M. Jodi Rell called the first auction of carbon emissions allowances under the Regional Greenhouse Gas Initiative (RGGI) a tremendous success. Connecticut will receive just over $4 million of the more than $38 million generated from the allowances sold for $3.07 a ton. In addition to Connecticut, funds will be distributed to Maine, Massachusetts, Rhode Island and Vermont. NORTH CAROLINA – DENR ‘UNADOPTS’ FED STANDARDIZED PERMIT The North Carolina Department of Environment and Natural Resources has officially “unadopted” the federal RCRA Standardized Permit Rule for treatment and storage found at 40 CFR 270.67. Owners and operators of treatment, storage and disposal facilities will have to follow the more strict state rules. 2 5 WEST VIRGINIA – MOUNTAIN STATE UNDER PM PRESSURE Businesses in much of West Virginia face stricter emissions controls and transportation-related sources additional planning requirements in the wake of the federal EPA’s announcement that ten counties in the state do not meet the 2006 24-hour standards for fine particulate matter (PM-2.5). OHIO – WATER REG REVISIONS COMING The Ohio EPA is in the midst of extensive revisions to the regulations protecting state lakes, rivers, streams and other bodies of water. The revisions will be presented in four rulemaking packages and will reflect the most recent scientific information and federal EPA guidance, Ohio officials said, as well as improving the clarity of the regulations. 9 ILLINOIS – AGGRESSIVE E-WASTE LAW Gov. Rod Blagojevich recently signed landmark legislation giving Illinois one of the nation’s most comprehensive recycling and reuse electronics waste, or e-waste, laws. The law authorizes the use of a combination of incentives and mandates to reduce e-waste, including TVs, computers, mobile phones and printers, and their toxic substances, such as lead, from going to landfills. Effective Jan. 1, 2012, landfills will be prohibited from accepting any covered e-waste. 6 3 SOUTH CAROLINA – LAB CERTIFICATION FEES ON THE RISE The South Carolina Department of Health and Environmental Control (DHEC) plans to increase its laboratory certification fees. Certification fees apply to any laboratory performing analyses related to environmental quality evaluations required by DHEC.
