Pollution Engineering - March 2009 - (Page 42) StateRules 8 brought to you by 7 5 8 2 1 6 4 3 ARIZONA – NEW WATER POLLUTION STANDARDS APPROVED The Governor’s Regulatory Review Council has approved new standards for the protection of surface water quality in the state. Under the new standards, two additional water bodies have been identified as Outstanding Arizona Waters. The first, Fossil Creek, is a major tributary of the Verde River and serves as the boundary between Gila and Yavapai counties. The second, Davidson Canyon, is a tributary of Cienega Creek in Pima County. LOUISIANA – CHANGES SLATED FOR GROUNDWATER MANAGEMENT The Louisiana DNR recently proposed amendments to rules to correspond with recent amendments to the Ground Water Resources Management Law. In addition to modifying a number of specific provisions in the state's groundwater regulations, the proposed amendments would add a new chapter addressing drought relief emergency orders. NEW JERSEY – REVISIONS TO TANK CERTIFICATION RULES The New Jersey DEP recently revised its rules in connection with certification to perform services on unregulated heating oil tank systems as well as on regulated USTs. DEP readopted rules that require contactors providing services on an unregulated heating oil tank system to pass a proficiency test in each area for which certification is being sought. Amendments were made to the regulations at New Jersey Administrative Code (NJAC) 7:26C (oversight rules) and NJAC 7:26E (technical requirements) that help facilitate and speed up remediation of contamination from homeowner tanks. 1 4 7 MARYLAND – NEW CONSTRUCTION GENERAL PERMIT ISSUED The Maryland Department of the Environment recently issued a new general permit for stormwater related to all construction activities disturbing 1 acre or more. New permit conditions include increased public notification and participation, as well as monitoring and plan review. The permit addresses several critical elements of site design and erosion and sediment controls. CALIFORNIA – VARIANCE FOR SAN DIEGO POTW The California EPA is proposing to renew a five-year variance from secondary treatment requirements at San Diego’s E.W. Blom Point Loma metropolitan wastewater treatment plant and its ocean outfall.The variance, which is contained in the facility’s NPDES permit, is contingent upon the city’s continued use of advanced primary treatment at the facility. 5 2 UTAH AND WISCONSIN – STATES ADOPT CRT EXCLUSION Utah and Wisconsin follow federal requirements for identifying hazardous waste and plan to adopt the federal conditional exclusion from the definition of solid waste for cathode ray tubes (CRTs) that became effective at the federal level in January 2007. Businesses may incur some costs for notification to the EPA of exports of CRTs outside of the United States. 8 MISSISSIPPI – REPORTING OVERFLOWS FLORIDA – SFWMD APPROVES SUGAR LAND PURCHASE After much deliberation, the South Florida Water Management District has approved the purchase of more than 180,000 acres of Everglades agricultural land for restoration from U.S. Sugar Corp. The transaction would provide water managers the opportunity to store and treat water on a scale never before envisioned for the benefit of the Everglades, Lake Okeechobee, and the St. Lucie and Caloosahatchee rivers. Aging infrastructure and increasing development are putting stress on sanitary sewer systems and leading to sanitary sewer overflows (SSOs). According to the Mississippi DEQ, when an SSO occurs, the cause is usually listed as a traceable condition such as a pipe break or pump failure, but merely repairing without understanding the underlying cause may not protect against future problems. Major causes leading to SSOs generally include age, lack of maintenance, poor operational procedures and inadequate flow capacity. 6 3 This update is provided by Business & Legal Reports Inc., practical EHS publishers since 1977.
