EU Commission Codifies Directive on TTE Market Competition The Commission of the European Union (EU) has reiterated its commitment to an open and competitive marketplace for telecommunications equipment and services by issuing a newly codified directive covering competition in the markets in telecommunications terminal equipment (TTE). The new directive, 2008/63/EC, consolidates and amends the essential requirements of Commission Directive 88/301/EEC, dealing with competition for TTE equipment, and Directive 94/46/EC, covering competition for satellite earth station equipment. Under the provisions of the new directive, EU member states must withdraw any special or exclusive rights they may have granted to public bodies, including national telecom authorities, regarding the importation, marketing or connection of TTE or satellite earth station equipment, or the maintenance of such equipment. Further, member states must ensure that all proprietary specifications for accessing telecommunications network interface points are published for use by equipment providers. However, EU member states may still refuse to allow any equipment to be connected to the public telecommunications network that does not satisfy the common technical regulations adopted under the EU’s R&TTE Directive (1995/5/EC). Further, member states can require that competitive economic operators possess the necessary technical qualifications needed to connect TTE to the network and to properly maintain it. EU Commission Releases Updated Standards List for the R&TTE Directive The Commission of the European Union (EU) has published an updated list of standards that can be used to demonstrate conformity with the essential requirements of the R&TTE Directive (1999/5/EC). The list of CENELEC and ETSI standards was published in June in the Official Journal of the European Union, and replaces all previously published lists for this directive. Marketing Company Gets $1.4 Million Fine for Junk Faxes The Federal Communications Commission (FCC) has issued a Forfeiture Order for nearly $1.4 million against a Michigan-based company for willful and repeated violations of its rules against the sending of unsolicited fax advertisements. The Forfeiture Order cites Extreme Leads, based in Auburn Hill, MI, for delivering at least 218 unsolicited advertisements by fax to at least 132 consumers. The unsolicited faxes were reportedly sent after the firm received a Citation from the FCC’s Enforcement Bureau, warning them against future violations. Violations of the FCC’s regulations regarding junk faxes typically result in proposed monetary fines of up to $11,000 per violation. The Commission’s multi-million dollar action against Extreme Leads follows a nearly $2.6 million Forfeiture Order issued earlier this year against The Hot Lead LLC, based in Addison, TX. In that case, the FCC cited the company for delivering at least 417 junk faxes to at least 149 consumers (see Conformity, June 2008). Updated Standards List for the “New” Low Voltage Directive Released The Commission of the European Union (EU) has published an updated list of standards that can be used to demonstrate conformity with the essential requirements of its directive relating to electrical equipment designed for use within certain voltage limits (2006/95/EC). The list of standards for the directive was published in June in the Official Journal of the European Union, and replaces all previously published standards lists.
