NewsBreaks Commission Proposes FCC Continues Actions Changes for 57-64 Against Jamming GHz Spectrum Rules Device Distributors The Federal Communications Commission (FCC) has proposed changes to its Part 15 rules that it hopes will further promote the availability of broadband connectivity. In a Notice of Proposed Rulemaking issued earlier this year, the Commission proposed to increase the fundamental radiated emissions limit for unlicensed 60 GHz transmitters with very high gain antennas, specify the emission limit as an equivalent isotropically radiated power (“EIRP”) level, and eliminate the requirement for a transmitter identification for 60 GHz transmitters. The Commission says that the proposed changes would allow for longer communication ranges for unlicensed point-to-point 60 GHz broadband digital systems and thereby extend the ability of such systems to provide high speed broadband services to office buildings and other commercial facilities. Once again, the Federal Communications Commission (FCC) is reaching right through the commercial distribution chain, levying fines not just against manufacturers of illegal transmitters but also against those companies that distribute and sell such products. In the most recent instance, the FCC has issued a Citation to Unbeatablesale. com for marketing police radar jamming devices manufactured by Rocky Mountain Radar of El Paso, TX. Agents of the Commission’s Spectrum Enforcement Division visited the company’s web site, and determined that the company was marketing certain models of radio jammers that had been previously found to be potentially capable of interfering with police radar. As we’ve previously reported (see Conformity, April 2007), the Commission issued a Notice of Apparent Liability earlier this year against Rocky Mountain Radar, the manufacturer of the specific devices that Unbeatablesale.com and other distributors were found to have been selling. Rocky Mountain Radar maintained that the devices in question were not intentional radiators, and that they “have been tested and certified by the FCC.” However, subsequent testing by the Commission found that the devices were designed to intentionally interfere with a licensed radio service and were capable of interfering with police radar equipment. Unbeatablesale.com joins a growing list of distributors who have received Citations from the Commission for the marketing and sale of devices manufactured by Rocky Mountain Radar. Earlier this year, the Commission sent citations to at least eight other companies who reportedly marketed and sold the same devices that appeared on the Unbeatablesale.com web site. In a separate action, the Commission has also issued a Citation against Scorpion Jammer Technology of Thornton, CO for marketing police radar jamming devices through www.scorpionjammers.com and www.activejammers.com. Radio Operator Fined for Failing to Make Equipment Available for Inspection The Federal Communications Commission (FCC) has issued a monetary forfeiture order against a Texas man for failing to make his citizen band radio equipment available for inspection by an FCC agent.
