NewsBreaks an agent access to his home to inspect his CB radio equipment. The agent, who was investigating a complaint of interference with CB channel 19, requested Winton’s permission to inspect the equipment inside his house but was refused. The agent then advised Winton of the Commission’s regulations requiring that such access be provided upon request and was rebuffed again. Finally, the agent requested that Winton turn off his equipment to prevent further blocking of channel 19. Winton did so, and the interference ceased, but he still refused access to the investigating agent. In response to an earlier Notice of Apparent Liability, Winton asserted that his CB transmitter was not turned on at the time the agent was investigating the interference complaint. Further, Winton claimed that, if the transmitter were operational, “it must have been operated by homeless people,” to whom he reportedly provides occasional access. The FCC rejected these claims, as well as Winton’s contention that he was unaware of any of the Commission’s regulations governing CB radios. The firms include: • Troescher Typing Service of Los Angeles, CA, which has received a proposed forfeiture of $22,500 for sending at least five unsolicited fax advertisements to consumers for commercial and residential refinancing and loans; • CyberData, Inc. of Hicksville, NY, which has received a proposed forfeiture of $13,500 for sending at least three unsolicited fax advertisements for mortgage financing and refinancing, as well as debt consolidation; • ESpeed Mortgage.Com of Pompano Beach, FL, which has received a proposed forfeiture of $13,500 for sending at least three unsolicited fax advertisements for mortgage products and services. In each of these instances, the unsolicited faxes were sent after the firms had received Citations from the FCC, advising them of complaints from consumers about their advertising practices and warning them that subsequent violations could result in the imposition of monetary fines of up to $11,000 per violation. But the Federal Communications Commission (FCC) is sending a clear message through a recent series of proposed fines against three operators.
