May 3, 2010 CRAIN’S DETROIT BUSINESS Page 17 Some businesses win better road project payoffs 10 holdouts remain, one heads to trial BY CHAD HALCOM CRAIN’S DETROIT BUSINESS Business owners in Troy may have collected up to $1 million to date above initial offers from the government for land they are losing to the city in an $8.4 million road widening and improvement project. Ten holdouts remain among the owners of 81 properties, most of them retail and restaurant businesses, along a mile or so of Rochester Road between Torpey north of Big Beaver Road and Barclay north of Wattles Road, plus half a mile of Wattles Road between Bristol Drive and Worthington Drive. Of those holdouts, Picano Restaurant Inc. and President Dominic Picano will be the first to go to trial today before Oakland County Circuit Judge Edward Sosnick for a portion of the restaurant property along Rochester Road. Nine more landowner cases await court dates between this month and Jan. 4. At issue is a road construction project now under way, with more than $6.7 million of Federal Highway Administration funds and $1.7 million in Troy city funds, that extends a median lane north to Wattles and generally takes about 30 feet of land from businesses on each side of the road. Darius Dynkowski, partner at Bloomfield Hills-based Ackerman, Ackerman & Dynkowski P.C., said his law firm has won $500,000 above initial offers among seven clients who have settled so far, including interest and attorney fees. Another five clients are still among the holdouts, including Picano’s Restaurant & Lounge and the Shell station belonging to Dearborn-based Safeway Oil Co. Inc. at Rochester and Wattles roads. Safeway President Sam Beydoun said the station has housed gasoline storage tanks underground in a public right-of-way since he acquired it in 2005. He said the city should help him pay to move the tanks as the project requires. “I never had any idea … that anyone was going to need to ex- pand Rochester Road again,” he said. “We never heard anything to suggest they were even thinking about it.” Birmingham-based Steinhardt Pesick & Cohen P.C. and Farmington Hills-based Berry Reynolds & Rogowski P.C. have obtained another $350,000 in additional compensation for clients, according to settlement documents and arbitration awards submitted to the City Council in recent months. Dynkowski said the business owners’ disputes with the city are less contentious than some condemnations the firm has handled, and he expects all could be resolved before the end of the year. Only 25 cases went to court for owners who didn’t accept the city’s initial offer to settle, said Troy City Attorney Lori Grigg Bluhm. “We’re pretty far apart on compensation with a few business owners, to where trials might be probable,” she said. “We have a set budget on the project that … (includes) right-of-way acquisition, as well as all costs and fees incurred. (And) we need to provide documentation of each expenditure.” Awards have ranged from $299,000, or $80,900 above the initial city offer for land to Century Plaza L.L.C. shopping center, and $270,000, or $114,406 above the initial offer for Rochester Square Associates, an Ackerman-Dynkowski client, down to $7,500, or $6,400 above the initial offer for JMT Properties L.L.C., a Steinhardt Pesick client.
