National Jurist - November 2007 - (Page 19) ronment for everyone,” Wiley said. “To stifle classroom discussion would be to abandon our mission, our students, and our society’s welfare.” Comments outside of the classroom Two law schools that recently dealt with professor comments made outside of the classroom handled the situations differently, resulting in different outcomes. L e o n a rd L o n g , a p r o f e s s o r a t Quinnipiac University School of Law, angered several students after he wrote in an email that law students would become “smug district attorneys wearing ill-fitting power suits.” The email was sent in February to everyone included on his “Suggested Readings” list. Long derided students about their concepts of how poor people and ethnic minorities are represented within the American legal system. According to Dean Brad Saxton, the email was sent to a fairly extensive group of students and faculty members who had indicated their interest in receiving his occasional comments on issues of social interest and suggestions for interesting reading material. Saxton said that while the tone and wording used were not those he would have chosen, he thinks Long’s intention was to provoke thought and debate about an undeniably important issue. He also said that absent extraordinary circumstances, he would never reprimand, discipline or otherwise discourage a faculty member, or student, for making strongly worded, provocative statements on issues of public concern. “Our policies and my own strong commitment to academic freedom and free speech encouraged me to avoid that kind of censorship with great care,” he said. Another law school did reprimand a professor for similar comments outside of the classroom, and it has led to a lawsuit. John Marshall Law School profes- sor John Gorby filed a $1 million lawsuit against his employer, saying he was improperly punished for what he believes were innocuous comments to a student after class. The student, who is Jewish, was asked whether his religious training contributed to Jews passing the bar at higher rates than African Americans. The arguments have been going for five years. According to an article in the Chicago Sun-Times, Gorby thinks the whole episode represents a stifling of the academic freedom that should allow him and other professors to have provocative discussions with students about subjects such as how to boost bar-passage rates, according to his lawsuit.
