Georgia Gold Medal Plant of the Month Adding a splash of color S BY CONNIE COTTINGHAM edum rupestre ‘Angelina’ is a groundcover that’s often used to add color and dimension to container gardens. It is dramatic when draped over the edge of brightly glazed pottery or softening the edges of paved walkways. The succulent chartreuse and golden leaves create a 4- to 6-inchhigh and 1- to 2-foot-wide plant that is a natural for a rock garden. Small, yellow fl owers cover the plant when it blooms. Sedum doesn’t ask for much water, but make sure it doesn’t get too much . Plant it in full sun to part shade and provide great drainage. The foliage takes on a russet tinge Liberty notes The right to remain silent BY JIM JESS T he Self-Incrimination Clause of the Fifth Amendment says that no one may be forced to serve as a witness against himself or herself in a criminal prosecution. Inherent in this protection is the right to remain silent. Anyone who watches TV police dramas can likely repeat the Miranda warning by heart: “You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, one will be provided for you.” The Miranda warning is the result of the 1966 U.S. Supreme Court case, Miranda v. Arizona, and has its basis in the Fifth Amendment, which protects a defendant from self-incrimination, and the Sixth Amendment, which guarantees the right to counsel. In 1963, Ernesto Miranda was ar- rested for kidnapping and rape. He was interrogated without having been fully informed of his right to remain 50B silent. Miranda signed a confession that included language about his legal rights, but the court said, “It is clear that Miranda was not in any way apprised of his right to consult with an attorney and to have one present during the interrogation, nor was his right not to be compelled to incriminate himself effectively protected in any other manner.” Writing for the majority, Chief Justice Earl Warren explained, “The prosecution may not use statements … stemming from questioning initiated by law enforcement offi cers after a person has been taken into custody or otherwise deprived of his freedom of action in any signifi cant way, unless it demonstrates the use of procedural safeguards effective to secure the Fifth Amendment’s privilege against self-incrimination.” In the Miranda case, Warren said, the offi cers neglected to provide “appropriate safeguards … to insure that More online at www.georgiamagazine.org the statements were truly the product of free choice. … if a person in custody is to be subjected to interrogation, he must fi rst be informed in clear and unequivocal terms that he has the right to remain silent.” The chief justice also said the FBI, followed a procedure of informing defendants of their rights. Warren commented, “The practice of the FBI can readily be emulated by state and local enforcement agencies.” This is why, to this day, law en- forcement offi cers are instructed to inform defendants of their rights prior to questioning. Then, when a case goes to trial, it will not be thrown out by a judge because a defendant has not been adequately informed of his or her rights. For more Liberty notes, see page 8.
