ELD Mandate Lessons: Opportunity,
Compliance, Tech Issues

T

he early lessons from the electronic logging device mandate include potential volume
gains for intermodal, high levels of compliance and no apparent effect on the freight
market after the penalty for ELD violations changed on April 1.

Motor carriers, suppliers, enforcement agencies and other
experts described that multi-faceted picture to Intermodal Insights
in the time since April 1, when truckers who don't have appropriate
devices could be placed out-of-service instead of just cited for a
violation.
Steve Van Kirk, CEO of Tiger Cool Express, made the case for
intermodal to benefit. "As ELD enforcement constrains truck utilization, intermodal will offer transit parity or even transit superiority
versus solo trucks in many lanes," he said. "This has the potential
to become a deal changer in our relationship with customers."

Frank Adcock, assistant vice president at TTX Co., said at the
IANA Operations & Maintenance Business Meeting that the ELD
mandate's effect, coupled with a strong economy, powered the
7.8 percent increase in domestic intermodal during the first four
months of 2018. There were some visible and generally positive
indications when it comes to compliance.
Collin Mooney, executive director of the Commercial Vehicle
Safety Alliance, said ELD violations were cited in just 4 percent of
roadside inspections, which he called "incredibly low."

A clearer picture of ELD compliance should emerge after the
CVSA's early June International Roadcheck program, which will effectively assess the compliance with the ELD mandate through the
focus on hours-of-service compliance.

Compliance Trends
Sgt. Todd Armstrong of the Illinois State Police said compliance
levels have been good among motor carriers, with no difference
between intermodal and over-the-road operators.
Fran Clader, director of communications for the California Highway Patrol, presented the picture of compliance in California.
"We have not collected enough data to say definitively, but it does
not appear the compliance level has changed since April 1," she said.
"At its onset, the contacts with intermodal drivers reveal that both
carriers and the drivers are uncertain on the ELD requirements," she said.
Many drivers aren't aware of the fact they are subject to federal regulations and don't know how to operate the devices if they have them.
There also are indications, she said, that some drivers are using
ELDs even though they don't need them because they only operate
within the 100 air-mile exemption.
